All Trump has to do is present information to the state legislative's that make them feel the vote was corrupted, then the 12th Amendment which favors the governing party with the VP happens.
State legislatures have the constitutional authority to conclude that the popular vote has been corrupted and thus send a competing slate of electors on behalf of their state. The 12th Amendment to the Constitution specifies that the “President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted.” That means that in the case of disputes about competing electoral slates, the President of the Senate—Vice President Pence—would have the ultimate authority to decide which to accept and which to reject. Pence would choose Trump. Democrats would appeal to the Supreme Court, and they would lose, we know this.
The 12th Amendment, and historical precedent offer a credible, stealthy, winding road that could lead to Trump’s victory and a second term for somebody who refuses to give up and fight until the bitter end. Biden should be worried, but he might be in a echo chamber of support.
He doesn’t have any.
. Yesterday, the judge hearing one of the cases asked Trump’s lawyers point blank, “Are you alleging that fraud occurred?” They said no. That’s because they would probably get disbarred if they made a Knowingly false claim.
