I am sorry to hear about your troubles. I think it might be worth sending the mortgage company another letter to notify them of your intention to sue, upon foreclosure of your home. Outline everything you have said here plus inform them of the firm you intend to use and your attorney/solicitor/barrister.

You need not wait for them to take your house to let them know that you intend to fight. I believe once they realise you are getting the LAW involved, they can no longer use delaying tactics or intimidation and slight of hand with your payments to threaten you. Simply use the rules we must live by against them and watch them sort things out for you in no time.

I have bought several properties and I worked several jobs while in the military to do it, but I never missed a payment.

There's clearly no evidence of Bank of america being a corrupt institution. I wonder why... Oh, that's right, they pay everyone off and delete all of the evidence!

Nice defamatory video. The news reporter cites no evidence, doesn't even cite a specific legal case pending. It's hard to take far-left videos like these seriously.

Funny how the far-left loves to bash the big mega-banks as their poster boy, and chooses to ignore a single iota of positive news about these very same banks, many of which provide hundreds of millions of dollars in grants to non-profits and philanthropic organizations.

Not to mention the tens of billions of dollars in loans given by banks to prop up businesses that are struggling. And let's not forget the massive tax revenue these banks pay each year, either. Naw, the banks are the bad guys.

Of course, you'll never hear any good news about these banks in the media. No, you just get to hear the stories of Occupy deadbeats that love to intimidate and scream afoul at the banks for the most ludicrous of reasons.

Here, buy a clue, folks: Make your mortgage payments on time and you can avoid foreclosure. Then pick up the phone and call any successful entrepreneur and ask them if they consider their banker to be a trusted adviser along the same lines as their CPA and attorney. End of story.



OP pulls the trigger quite knowingly--it was no accident at all, and blames the gun. What in Heaven's name did he think was going to happen? He signed a Deed of Trust that enjoined him to make mortgage payments on time every month. He promised to do that. That Deed of Trust is probably 25 pages long. All it says really is this: "You keep the house up to snuff and make the payments on time, and we'll leave you alone. If you don't make the payments, we'll take the house. There's a bunch of mumbo jumbo in there, but that's really all it says: Make the payments. It doesn't say, "Make the payments unless you have other priorities." There is no provision for other priorities. There is no provision for "skipping" a payment or two if you feel like it. It's a legal contract. What don't you understand about that?

I feel terrible for you, as I am trying to retain my home right now. Not going to go into my story, this is your thread. I do want to ask though...have you worked all of the possible angles? A modification or a partial claim? Banks are usually more in favor of doing so than not. Make sure you've explored your options, and don't procrastinate like I did for so long that its all-consuming now trying to beat deadlines. Good luck to you.

It's all just a matter of playing the game.

A lot of people bought homes at the peak of the real estate boom and have been paying the inflated mortgage payments expecting a turn around, or just not knowing of any way out. Yup me and Katy are just going to give up buying non essentials except for a Sunday treat at the dollar tree store for the next 24 years.

The realtors are getting more and more creative and there are people seriously underwater finding ways to upgrade their living situation. Some who are well off are buying new homes twice the size and in better neighborhoods before handing the keys from their old prison digs to a realtor. The realtor then goes through the rent/short sell/preforeclose on the old property.

In the past you had to actually miss payments before a short sale would be considered but that is no longer the case. In fact, you may even be able to purchase another home right after closing on a short sale if you do not have any missing or late payments, otherwise qualify to purchase and have been fully released from liability after the short sale.

Might not be too late to get the short sale paperwork started in your case but you need to find an REO pro who knows the loopholes. Its not a level playing field there are still law firms out there advising clients to file a chapter 13 because the client struggled too long and can't afford to pay the legal fees!

Sheepslayer, I almost forgot: check your state's laws regarding foreclosures. Where I was (AZ), in the event of a foreclosure, I didn't owe them anything, which is why it was slightly easier for me to walk away. I owe them nothing, I only have to suffer the hit to my credit.

Actually, the exact reverse is true. A lot of small businesses are tax cheats, especially cash businesses. Big corporations donate tens of millions of dollars in charitable donations to organizations like the United Way, etc.

A lot of small businesses are run unfairly - The "family" runs the company, and Guido the CEO plays politics choosing his grandson for a promotion over employees that actually do their job. Family members get perks -- They get to show up late, take days off whenever they want, etc.

Most of these small businesses are run like mini-dictatorships, where the CEO takes the profits and the employees get squashed. At least in a big company you typically have unions, or at least a more equitable playing field to compete on a more equal basis. Bigger companies are much more reasonable in the way they deal with their employees, and typically treat their employees much better -- better benefits, better sick pay, etc.

I hope those dumb bastards do possess your home, that way you can sue their buns off. Never let them keep you down, it doesn't matter how hard they hit if you're relentless in getting up.
