NRDC director Peter Lehner's Letter to BP

June 14, 2010
Tony Hayward, CEO, BP

[...]
To ensure that the $500 million is spent in a way that advances scientific understanding of key issues, research should be selected, funded, overseen and disseminated so as to produce accurate results and greater public and scientific understanding, not in ways that distort or appear to distort the research agenda or research results, or that mislead the public about the true impact of the disaster.
[...]

1. The money should be put into a fund overseen by an entity that is completely independent of BP and any other oil industry ties or influence.

[...]

2. The data and research results from the research that BP funds must be made public. BP should have no control whatsoever over the design of the research, its conclusions or its publication.

3. BP must not ask scientists to limit their ability to testify in court or elsewhere for any party.

Peter Lehner
Executive Director, NRDC

I'm working to find a copy of the confidentiality agreement in full text... no luck yet. Its out there though.

also... from your source:

NOAA officials did not answer requests for comment. The agency also did not respond to a request for the contracts that it offers scientists receiving federal grants. Several scientists said the NOAA contract was nearly as restrictive as the BP version.

We have been discussing this on several facebook pages. We are ground zero of the oil spill. Any southern universities that take the money and lie well be dealt with. You don't keep things quite among Southerners.

Editorial: Let UWF test water

July 16, 2010

The decision by BP to stop reimbursing Escambia County for water quality testing done by the University of West Florida — and the apparent meek submission to the demand by the Florida Department of Environmental Protection — is short-sighted and counterproductive.
[]
It is also not the first time we've heard complaints from university scientists in Florida about efforts that appear aimed at keeping our universities at an arm's-length distance from collecting needed data on the Gulf and the impact of the spill.

HERE IS THE INFAMOUS CONTRACT

The story was picked up by BBC NEWS TODAY:

www.bbc.co.uk...
BP accused of 'buying academic silence'

"It's hugely destructive. I mean at some level, this is really BP versus the people of the United States."

Transcribed from the REDACTED CONTRACT:

All communications (including non-public information disclosed in such communications) between you (and your agents), BP Attorneys and/or other BP representatives in the course of your performance of BP NRDA Services are deemed to be incidental to the RENDERING OF LEGAL SERVICES and are to be privileged and confidential.(//////ONE LINE REDACTED/////)unless or until a person from whom you are authorized to take instructions informs you in writing that this restriction is no longer applicable to any particular non-public communication or information. In the event you are required to disclose such privileged and confidential non-public communications(//////2-3 words REDACTED//////)by an order entered by a court or by similar judicial process, or by a judicial or administrative subpoena, you shall notify a person from whom you are authorized to take instructions as soon as practicable, and you are required to cooperate with BP if BP decides to seek relief from such required disclosure, including commencement of legal or administrative proceeding to prevent or limit the disclosure of such privileged or confidential non-public communications or information.

The subsections on "termination of services" and "publication" are heavily redacted.

still seeking a clean original,

gee i don't hear any more talk about how californians are a bunch of eco-freaks now! we are enjoying our beaches. too bad so many good people of the south have to endure the big oil, big business, crap the republicans down there forced down their throats, by trying to cut every regulation they possibly could...how's that working out for you now.
sorry, but as a californian, i have heard that crap for decades, and any sympathy from me ONLY goes out to the poor people that tried to do something about it.
