Executive Orders, Abortion & Obama Care Question...

So, we've heard all the talk about Executive Orders and how they must be obeyed...

Yet, the Abortion EO that Obama signed will supposedly be invalidated at the first challenge.

So... Riddle me this...

If an executive order can't change the law...how can he use it to keep his stuff private from the freedom of info act



I would presume that until the EO is challenged in a court of law it's virtually worthless?

Can we get Judge Napolitano to comment on this?

Yes, I went round and round with a member on this very issue. First off, a EO cannot override legislation. It can only be used to further a law or to verify an ambiguous law.

Now, if there is a law in the new bill that allows abortions to be paid for by the federal government, the new law has precedent. I do not think a previous law needs to be repealed, it just needs to be invalidated by the new law.

I did see a show with Napalitono going over these components. I will try to find it on utube and will post it, if it exists.
