A British “UFO eccentric” accused of hacking into US military networks brought a last challenge in the High Court yesterday against extradition to America on health grounds.

Lawyers for Gary McKinnon say that he should be tried in Britain because of his Asperger syndrome and the severe mental distress he could suffer if sent to the US for trial.

His lawyer, Edward Fitzgerald, QC, told the court that there was “clear, uncontradicted expert evidence” that the stress of extradition could result in psychosis and suicide because of his illness.

Mr McKinnon, from Wood Green, North London, is seeking a judicial review of the then Home Secretary Jacqui Smith’s decision last October to allow extradition.

I always thought they made a big fuss about it and then hire the guy to make the system more secure?

If you take someone with Asperger out of his normal enviroment they would have a lot of trouble adapting. He might hurt himself, but they probably do not care.

I did not know they could extradite a person without any evidence. This world is getting more crazy every second.

i think it should be made clear that Asperger's Syndrome, while real, is USUALLY a convenient explanation for social retardation. In fact most so-called Aspies are even self-diagnosed.

The line between high-functioning autism and being really, really bad with people (like unable to even talk to a woman) is a very fine one only a trained psychologist could really differentiate.

asperger syndrome is a autism spectrum disorder.

ASD begins in infancy or childhood, has a steady course without remission or relapse, and has impairments that result from maturation-related changes in various systems of the brain.

Hopefully he has medical history of this illness, or what you say is right, his lawyers may have a hard time pulling this one off.

NASA (the US Govt) should let this go... What this exercise demonstrates is weak security on the govt machine due to pretty common exploits. If anything, improves their own security at the expense of a benign hack which is a lesson everybody learns from. I know that other govt agencies have been hacked with must more passive approach. Security has always been a cat and mouse game. with NASA especially... Inspired from the movie "War Games"... so they should sort of expect that hack attempts to come at them. And when they fail at their own jobs.... they cry foul. NASA/DoD needs to just fix their own problem and move on. Gary McKinnon does not appear to be a threat to National Security IMHO...

Why don't the US offer him a job?

Court date set for Gary McKinnon

He has now been granted permission to appeal a separate decision made by the Director of Public Prosecutions in February this year which stated that he could not be prosecuted in the UK.

Judges will wait to see the out come of his latest review, on July 14, before making the final decision on his future.

Nervous wait for the lad.
