Man Blames Rental Car Company For Wrongful Arrest

Here's some more nonsense by the police:

CHICAGO -- An Enterprise rental car contract promised a man a Chrysler Sebring but ended up delivering him an unwarranted arrest by Chicago police, according to a lawsuit filed Friday.

Marek Procinski rented the Sebring on Sept. 14, 2007, from Enterprise Leasing Company of Chicago Inc., 5358 W. Irving Park Road, and assistant manager Rafal Gembarzewski, according to the suit filed in Cook County Circuit Court.

While driving to pick up elderly relatives from O'Hare International Airport, Procinski was pulled over by Chicago police offices and arrested on a charge of driving a vehicle they suspected was stolen, the suit said.

Procinski was forced to exit his rental car, then placed against the car with his hands and legs spread while he was frisked, the suit said. He was then taken in a police squad car to the District 15 station where he was booked, fingerprinted and placed in a detention cell, the suit said.

He was charged with possession of a vehicle title and registration not authorized to the vehicle, possession of a vehicle with no valid registration and possession of a vehicle having a false temporary plate, the suit said.

The suit claimed Enterprise gave Procinski a car with an expired plate that was registered to a 2008 Dodge Avenger, not the 2007 Chrysler Sebring he rented.

The suit said he not only had to endure being wrongfully arrested and detained, he also had to pay attorney costs to fight the charges in court and now has an unwarranted arrest record. He also was unable to meet his elderly relatives at O'Hare as he planned, causing additional distress, the suit said.

Procinski is asking for more than $50,000.
