That's true, but would that also apply to the drug paraphernalia charge?

If it were me, the first thing I would do is check around to see if someone I knew had a buddy on the police force. Maybe a friend of a friend could try to explain the unfortunate incident to the cop that pulled him over and maybe as a favor, purposely not show up in court.

Sadly...the prisons and jails are full of folks saying "But, its not MINE!" and "I don't know how it got there!" and "But, I don't even USE drugs!".

Problem with that is you were in control of the vehicle at the time, your "explanations" were standard for folks busted, and you are, should and are supposed to know what is in or was smoked or drank in a vehicle you are operating.

On that? It was there, you had it, you were driving, and the cop saw it and found it.

Brother's or not...its up to the judge. I hope for your sake he's understanding...and you come across as believable.
