I think condemnation is where the problem may be misconstrued. If a christian believes another is going to hell so to speak it should not be a condemnation but instead merely resignation to Gods supreme judgment and will. I think atheist or other non-believers take it as a personal judgment rather than a statement of doctrine.
"Thou shall not judge" is NOT stating an opinion for goodness sake

A more accurate translation of that is
"who gave his Son authority over all things, will be utterly supreme over everything everywhere."
Says the same as God has dominion over all, just this translation is more word specific and easier for us to understand in English

What its saying is regardless of that persons actions in life... They will burn only because said person does not believe the same thing as the other person.
Meaning that belief is authority because a book says it is....
I love how Christians always try to sidestep their judging of others...
