With the soon to be real January 1st insurance policy starts, many people will not be able to be "verified" by the insurance companies that may or may not have the correct enrollment information and most importantly the payments either from the insured and or the government subsidies.

Of course this is going to be one massive headache for people as well as insurance companies and health providers not to mention the government bureaucracy itself.

This article is a standard bash but in light of that, we see two ironic points that conflict with the laws.

Ignore the bashing and focus on the facts presented.

This is all well beyond speculation and is definitely in "Red Alert" territory.

The government itself is admitting themselves to the "asylum".

Point 1.
HHS is "asking" insurance companies to put themselves as well as customers in jeopardizing positions...

Among the guidance the HHS announced:

— It is requiring insurers to accept payments until Dec. 31 for coverage starting on Jan. 1. It is also “urging” insurers to give individuals more time beyond that to pay for coverage. In other words, if somebody pays for coverage in the middle of January, HHS is asking insurers to retroactively make that person’s coverage effective as of Jan. 1. HHS is also asking insurers to cover individuals who offer a “down payment,” even if that payment only covers part of the first month’s premiums.

— In a press release, HHS said it was also “strongly encouraging insurers to treat out-of-network providers as in-network to ensure continuity of care for acute episodes or if the provider was listed in their plan’s provider directory as of the date of an enrollee’s enrollment.”

— HHS is also “strongly encouraging insurers to refill prescriptions covered under previous plans during January.”

On a conference call, an HHS spokeswoman emphasized: “We are just proposing it as an option and we’re encouraging issuers. There is no requirement.”

a bit on the sloppy side I would say !!

The administrative and bureaucratic nightmares are just beginning !!

The government is actually asking private companies to go along with the failures !!

Unbelievable to say the least.

Point 2. HHS may have broken a different law too !

Under the the Federal Information Security Management Act (FISMA), the Department of Health and Human Services’ Center for Medicare and Medicaid Services (CMS) is required to have an “Authority to Operate,” or ATO. In order to receive an ATO, new information tech systems must perform a set of tests, including “Security Control Assessments” (SCA).

But according to CMS’s 2014 budget request, no such security assessment took place. The Federal Healthcare Marketplace website was rolled out without full end-to-end testing.

Indeed, the large number of new systems created because of Obamacare created a backlog of testing. CMS could not complete its required security. Failing to complete the required means no ATO, and hence a violation of federal law under FISMA.

Ohhh BOY !

Insurance providers once again invited to ignore “the settled law of the land”

The only thing that would make this more entertaining, and unfortunately more unfortunate, would be if Hillary were in charge.

What difference, at this point, would that make?!

Maybe she can coach Sebelius for the next round of investigations. You know Congress will hold them and pretend once again to care.

HHS added an additional last-minute request...

""HHS is also asking insurers to cover individuals who offer a "down payment," even if that payment only covers part of the first month's premium.""

Send in $10, go get your surgery, and then cancel the plan! This administration is going off the deep end.

And think of the lawsuits too !!

There will be law firms that can work exclusively for years on just ObamaCare cases.

This could be bigger than the asbestos cases.

The Mess Keeps Getting Worse !

I was watching a Senate hearing that occurred today on one of the C-SPAN channels. Senator Issa directed the hearing with 3 "specializing" doctors.

One of the Senators was from Oklahoma. He said that there were 1400 small businesses in just Oklahoma City that have receives insurance cancellations. One business he mentioned was a small car dealership with 14 employees.

Remember the 5,900,000 "people" who have received cancellations? I really believe that to be "policies". I also believe that the average number of "people" per "policy" will be Greater-Than-ONE ... SO, who knows how many people have actually lost their health coverage AND how many of these are already in an active-treatment process?

Those doctors weren't sure that they would be able to refer patients to other doctors because of the patients "in" or "out" of network status and/or if the "referred" doctor was "in" or "out" of network OR the doctor would be listed in any "network".

One doctor said that the Obamacare "guidelines" would prevent him in some cases to not be able to prescribe the most-appropriate drug to the patients ... (the "guidelines" force a specific-sequence of prescriptions).

These "interviews" should have been more significantly nationally televised. The word "death panel" did come up on two occasions BUT Senator Issa instructed everyone to NOT use that description.

One of the "specialized" doctors issued a warning using the term ... "T Minus 20 Days and Counting" ... (referring to the number of days remaining until 2014)

"The Mess Keeps Getting Worse !" ??? ... We ain't seen nut'n yet.

The GOOD NEWS ???

How little more will it take to "Expose" Washington D.C. for what it has become?

Three hundred and ninety four million has been spent on the ACA so for....with millions more projected to be spent. That's a lot of money, mostly making crony's rich.
NOBODY (IMO) could 'accidentally' develop such a messed up program - not even the government. This convoluted mess appears intentional, to me.
So what is this truly about?
It would appear that it is going to decimate middle class America, and allow the rich to get richer in the process.
Our politicians are leading America down a path that will not have a favorable outcome.
Republicans and democrats have become 'bedfellows' playing a never ending game of 'good cop; bad cop'.
God bless the USA.

I think that we're looking TOO HARD at the federal level ... ( seems like a HUGE WASTE of Time and Effort to me ).

I think it's time to focus our "time and effort"(s) back to the individual states. The "states" have more power (especially when the states work together) than "We the People" realize.

Summary: Support and Empower YOUR State !!!

Doctors are also very concerned because they are about to get a 25% Medicare pay-cut in January. In one of our Chicago area counties, every gynecologist has stopped accepting Medicare patients. This county has over 170,000 seniors.

When loved-ones start dying due to these heavy handed ObamaCare changes, we'll start hearing news stories about relatives attacking the government offices that make and enforce ObamaCare. The government murders people all the time, but never this overtly.

Dude, of the populace has not seen yet what DC has become, it's too late. And I fear that most people have not.

The ObamaCare defenders will also tell you that the policies that were cancelled were "junk insurance."

Somehow, I don't think my 60-something parents had junk insurance just because it didn't cover maternity care and contraception.

Well, there's your death-panels. Actually, it is turning out to be quite a bit worse (okay, a LOT worse).

Cheers to all those silly people who said there is no such thing as "death panels"! Silly people. Of course there won't be "death panels". Since a "panel" is normally made up of experts, we don't have no "stink'n experts". LOL No experts = no panels. See? All fixed. No doctors = no unfair treatment. Socialism...F*** YEAH!
