A man accused of murdering an escort he found on Craigslist who refused to have sex with him was acquitted in Texas, Wednesday.

Apologies if this has already been posted, I did a search but could,'t find anything.

I find this story quite disturbing, Ezekiel Gilbert has been acquitted of murder after he shot and killed a prostitute who took his money ($150) but refused to have sex with him, this happened in 2009 but has only just come to court.

Apparently he got of with the murder under a Texas law that states:


Under Texas law, it’s legal to, “use deadly force to recover property during a night-time theft.”


Even though prosecutors argued that prostitution is illegal, and that trying to force someone into having sex for money is also an illegal act and that the Texas law was designed to protect law abiding citizens from being robbed in their homes at night....Gilbert's lawyers managed to get him acquitted.

Now to me this would appear to be no different than a drugs dealer failing to supply the drugs he had been paid for, and his "buyer" shooting him dead and getting away with it!

Crazy stuff!

Legalize it. Regulate it. Tax it. Everyone will be safer and it will raise tax revenues.
There are a few other illegal things that should also be treated in this manner, but
we wont' go there on this thread ...

Well this is just stupid.

Why don't all people who kill from now on just say the person was stealing from them during the night, great loophole in the law.

I agree with you 100%....but the facts are that in Texas prostitution is illegal, so how can someone be acquitted of killing a prostitute under a law that was created to protect law abiding home owners from being robbed at night?

The guy was breaking the law, as was the prostitute.

Not sure how "regulating" it would have stopped this particular incident

Revenues are raised as the prostitutes then spend the money in the wider economy- why give more money to the greedy state to fund wars

Good point.....if prostitution was regulated and legal....would this murder have not happened ....or been any less wrong?

But LEGALIZE IT for sure.
Everyone one does it, but if you take money its illegal? How stupid is that!

As for the poor woman mentioned in the OP? Nothing we can do for her.
As for the guy who killed her? He should be doing time. She was NOT a threat to his life so he should not get away with killing her.
