"ederal Judge Rules Against Portion of Patriot Act, September 29, 2004 A federal judge in New York rules that a slice of the USA Patriot Act is unconstitutional. The judge said part of the law increasing the FBI's power to demand financial records from companies does not provide sufficient opportunity for a court challenge. NPR's Larry Abramson reports"

The judge stated that the U.S constitution still applies even during the "war on terror". Nice...The founding fathers would be proud.

Justice department has not, at the moment, decided to appeal the ruling. With their recent "defeats" in the supreme court they might choose to let this one ride.

Article 5.05 of the Pariot act was the section overturned.
