The cop talked him into exiting the home and thats the only reason he was allowed to arrest the professor. Once the proffesor stepped outside he lost his rights due to being in public.

No, that is not the correct procedure. The police have to clear the scene. Many scenarios could be playing out behind a closed door. A restraining order could be in effect that had been violated.
They don't just say "sorry" and walk away. Not responsible cops.

The cop should have complied with the request then left the property no matter what was being said to him. Gates had not broken any laws.

If the professor was so smart he should have called the police station and told them he had to break into his own home.
