Until somebody started listening to the kids and guess what, his case was one of the most followed case we had in our small town for years if no the first one ever.

He was found with child pornography in his computer at school . . .

Maybe one of the complaining kids put it on his computer...

If the principal from the website story was wrong, the kids still went about a solution in the wrong way.

He admited to the charge and a lot more . . .

Justin was the only student in the school to have admitted creating one of the four websites. He has apologized twice to Mr. Trosch, once in person and once in writing. He did this without prompting from anyone else. He is sorry and embarrassed by what he calls a dumb mistake.

Admission of guilt

That is how I know if he is guilty or not he admitted it

I don't think the students guilt is what Marg was questioning. I'm pretty sure she's questioning whether or not there's any truth in what the students put in the MySpace profile. The principal denies that any of it's true, but what if it is? What if only parts of it were made up but there is still truth in it? From what I've seen kids tend to act up for a reason.

Anyway, I'm not sure that suing them is the best punishment... I agree they need to be punished, because even if it was true they had no business putting it on the internet, but suing them isn't really going to do much to affect them. They (or their parents since I didn't see any mention of ages) might have to pay damages, but that doesn't teach them or any one else not to do it. It only teaches them that they might have to pay someone if they do. When I was in middle school they still gave you whacks on the bottom with a paddle for misbehavior. Got paddled once for fighting and I never did it again. But now if you so much as look like you might spank your child someone's calling social services... I think that's the main issue here. Parents don't really punish their children anymore. Time-outs and no privileges only work for so long and then you just need to give them one good swat on the behind* and they straighten up. I think that if these students had ever actually been punished for doing stuff they knew better than to do, this wouldn't have happened.

*just a side note for those who would flame for advocating giving a child a spanking when they deserve it, there's a big difference between a spanking and a beating. I do not advocate beating children, but if they do something wrong and time-outs aren't working, one good swat on the behind will work.

I was a teacher for 9 years, kids can be very vicious sometimes but their viciousness comes with a reason, usually is something behind the dislike of one particular teacher or let say principal.

Sometimes we teachers has to dig out what is making the student unhappy.

Sometimes is nothing more than littler silly things but in other occasions is a lot more deeper and broader.

This story should be followed to see what it ends into.

Marg you can attempt to defend them all you want, but that will not change the fact that at least one of them pled guilty and has been convicted in a court of law.

Did you even bother to read what the one admitted student postsed? I doubt it

I'm impressed shots, you're certainly a very patient person. I wonder if Marge realizes that her credibility is taking another dive due to her inability to answer your simple question.

You are of course correct in everything you said and her comment about free speech pertaining to the situation is completely wrong as it is a clear act of libel (which you kindly posted definitions for) on the students parts.

Doesn't seem very scholarly of her to ignore your presented and established proof.

One student is using free speech as an excuse. :shk:

What I would really like to know what is wrong with the younger generations, they seem to think they can get away with anything they want and claim it is free speech?

The information posted was done with malicious intent his conviction and guilty plea shows he knew he (the student) was wrong.

This falls under tort laws and is not considered as free speech therefore he can sue and recover for damages,

these are highschool kids, and i cant beleive people are actually talking about letting teachers hit kids...

in highschool if i a teacher ever lifted a hand to me, the paramedics would throw up when they saw what i did to said teacher. i want to see a little glasses wearing principle try and hit a 17 year old, 180lb kid from the football team.

sounds like inviting disaster, give the teacher the right to hit me and i promise you i will reciprocate that right.

While I may disagree with what they are doing, they are well within
there legal rights to do so, as is protected by the first amendment.

I do not believe that the principal should be allowed to sue them,
however MySpace should remove it and ban them, as I would suspect
that slander and defemation of character and outright lies about an
indiviudal are not allowed under there terms and conditions of use.

Actually they are not well with in thier rights they violated the law....Defamation of character, Slander. It has an effect on the mans life, job, family, etc. people hide behind the 1st amendment to much in this country. Bring back coorpral punishment and lets see how much these kids act up then. When I was in school and you got in trouble you were sure you were going to get the paddle. Our principle was smart. He would come into shop and make the paddles himself
bore holes in it so the wind would not slow it down and hang it on the wall for all to see what you get if you act up.I myself was on the end of that paddle several times and I stopped being a jerk real quick.
