He told me he drove it in by accident and could not get it out. It was late and he left it for the morning. So then the police knock on his door and tell him he has to get it out the ditch. He tells them it's his car on his property and he will do it in the morning.
They tell him they keep getting calls about it and he gotta move it. He says he can't so they called a tow truck at his expensive.


So my question is who was in the Right was it my neighbor or the police?

A guy I was talking to told me he felt like you should be able to park your car upside down on your own property if you want. He would have in the most respectful way told the officer to please leave his property and if he proceeds to remove his car off his property that would be considered stealing.

If its a ditch off of the road its technically an easment.


Local laws of course apply.

It is common to see abandoned crashed cars on the side of the road with some police tape around it and a sign letting the public know the police already know about it. Don't bother calling.

Waiting til the next day appears reasonable. Trying to sort out such a mess with midnight overtime rates appears a bit excessive in the situation. Does not sound like it was an emergency situation.

In the UK years ago, people used to write "police aware" on a damaged car by the roadside on the windows usually in lipstick.

Common sense so that people didn't keep phoning the police.

What happened to your friend does show that people care enough to keep reporting it.

Sadly, too much.

But if he was drunk when he drove into the ditch, serves him right for any costs he must pay.

I'm with the owner.
I'd have half a mind to park that car upside down on my roof after that- or through a wall six feet off the ground..

Everybody needs to get their noses out of this man's ass, he's working on it.

The police, in this case, can go suck an egg. If they don't have anything better to do than mess with this guy who is clearly already having a bad day (but on his own property and not harming anyone else) then perhaps they should find new jobs.

Not enough details to say who is right or wrong. If the ditch is on the side of a public road, the cops are right. If the ditch is alongside a long driveway on private property, cops are wrong. And so on. Too many variables.

Hmm...not sure what the laws are there, but I have 40 acres and the ditches around the outside of my property technically belong to the Township, so if that happened to me, they would be in the right to have it towed or whatever.

Not sure if that applies here, depends where the ditch is, I guess.

Easements, culverts, ditch, drive next to grass or yards ..belongs to and can be forced compliance from your city, town, county even Stae gov.

Here, an issue is people park in their drives, blocking the sidewalk. So no elderly, disabled, kids and strollers cannot pass your house.

And that...is illegal.

PS I own 2 homes.

Private property is private property until it causes issues with public property. This is why a house can’t have blaring bright lights flashing at motorists, or a giant billboard of a gay orgy in their yard.
I’m sure each town has their rules on what is allowed/not allowed.

Funny you mention that, billboards DO have requirements.
Some in the past that caused accidents were made to be taken down.

Cops get carried away with themselves and start barking orders about silly stuff, if you ask me.
One cop said to me, 'You are on camera' - to which I replied, 'Yeah? So are you!'
Their job is 'To Protect And Serve', not to bully or do as they please.
Meanwhile, when something really serious does happen and you require their services, they forget that we are paying their salaries and they work for us.
I've always been on their side in issues, but lately I see another side to them.
