Not if they're union.
Wouldn't matter one little bit over here, I can assure you anyone found like that in almost any work environment would be immediately suspended
pending disciplinary investigation and I can guarantee you they would be sacked regardless of union membership or not.
Unless of course they were one of the bosses.
I'm led to believe that US workers have less employee rights than their UK/European counterparts, maybe that's wrong?
