CNN article all the way back on Groundhog Day admits that investigators were having trouble making a criminal case because they have no proof that the officer was even injured at the Capitol. They don't even have proof that he was maced.

Investigators are struggling to build a federal murder case regarding fallen US Capitol Police officer Brian Sicknick, vexed by a lack of evidence that could prove someone caused his death as he defended the Capitol during last month's insurrection. Authorities have reviewed video and photographs that show Sicknick engaging with rioters amid the siege but have yet to identify a moment in which he suffered his fatal injuries, law enforcement officials familiar with the matter said.

But, even though they have no evidence, they opened a Federal murder investigation...

Soon after Sicknick died on January 7, prosecutors in Washington opened a federal murder investigation, dedicating a team inside the US attorney's office to build out a case, authorities have said.

But all the news media were telling us that he had been murdered immediately after the man died.
Seems a bit fishy to me.


One possibility being considered by investigators is that Sicknick became ill after interacting with a chemical irritant like pepper spray or bear spray that was deployed in the crowd. But investigators reviewing video of the officer's time around the Capitol haven't been able to confirm that in tape that has been recovered so far, the official said.

They went to mace because there were instances of it being used there.
There was a woman shot inside the building, so there were guns there too.... maybe they want to try that next... no wait, he had no injuries.

No, my point was that he may have had some other underlying medical condition that would have killed him anyway. A ticking time bomb, so to speak. Untreated high blood pressure, arteriosclerosis or a blood clotting issue.




Secondly, because of your assertion, were that to be argued in a court of law, then the onus is on the lawyer making the claim that "he would have died anyway" to prove that on that day at that time, he would have died. So, stupid rebuttal #2.

In the United States, the onus is on the prosecutors to prove to a jury that a defendant is guilty. The defense saying that the decedent may have died of some other underlying cause could be backed up by presenting the cop's health records, whether he was overweight, etc... for the jury to look at when making their decision. It would be to create doubt in the jury that the defendant (which there isn't one) killed the cop.
Funny that, no person is accused at this point, and the cause of death was a stroke that was NOT preceded by a blow to the head.
As it is now, there is no cause for the stroke that he suffered. People have strokes. My uncle died of one years ago, he was sitting at the breakfast table and keeled over backwards... with no imaginary fire extinguisher hitting him in the head, as in the way this story began.

Yeah. In order for manslaughter or any kind of negligent homicide to be charged, there has to be some way you could possibly foresee the outcome.

If I push someone 10 feet back from where they are standing, and then a small meteor falls from the sky and kills them while they're standing there, the fact I moved them 10 feet doesn't make it my fault.

(The odds of getting hit by a meteor would be the same if I hadn't moved them. It's only in hindsight that the place they were moved to is known to be less safe than the place they were initially.)


Mace has no track history of causing blood clots.

That individual, by letter of law used a chemical weapon against law enforcement. They should be charged.

There's for sure one dead body, a homicide (babbit), that absolutely occurred amongst the commission of many crimes, multiple cases of assault and battery against officers, and attempted murder against officers( the kid with a bat and beating the cop with a flagpole).

There should be a few long sentences given. Everyone there wasn't a terrorist but some were.
All because they believed a New York billionaire.

The family of one of the officers who died of "natural causes" the day after the Capitol was breached (Brian Sicknick), refused to shake hands with Senator Mitch McConnell, and Congressman Kevin McCarthy, during the ceremony.
