Yes he does. He has the full power of the 2018 EO. That put the elections under a state of emergency. That is still ongoing. He could also use the Insurrection act which would allow for the use of the military to uphold matters the police or law enforcement agencies do.

If you are in any doubt regarding this. Why did they slip in nullifying the Insurrection act in the recent Stimulus. These peeps are running for the poop poop paper. But this is the year 2020 and they are going to get caught short.



First of all, he can't bestow powers on himself by Executive Order that he doesn't have constitutionally.

Second, and last, he doesn't have the constitutional power to declare martial law because his fat ass lost the election.

The insurrection act has nothing to do with martial law. Its about using the military to do the job law enforcement should be doing.

It clearly states that is there is foreign interference in the election then all assets can be seized. (the military have the evidence)

No they don't. All orders to military units, whether they be Special Ops or line units, have to come through the Joint Chiefs, which means the Pentagon. Civilians can't give orders to military units. The 2017 NDAA ordered that SOCOM be raised on par with other military departments and their civilian leadership report to SecDef as those other departments do. And then what? Pence wimps out... MILITARY seizes the voting machines... and then what? Especially if Trump wins. What changes. We already had voting machines examined, potential (even likely) fraud is found, and it's gone nowhere. So what exactly will the military be expected to do then?

Is seizing machines really ALL the military will be expected to do? I don't believe that for a minute. Trump doesn't need the military to find the truth. The military isn't in the fact finding business. The military is in the death and destruction business.

And I agree with you, but this being ATS, there may very well be a way the DS has corrupted S.Ct. Justices as soon as they get on the bench. Some of their rulings make zero sense, especially lately.

So, I know it's the Mud Pit and everything ... but does anyone want to take a stab at actually making sense out of the OP?

Because all I see is a poster regularly advocating seditious actions like keeping the duly elected President from taking office.

The argument, loosely, is that Chief Justice Roberts isn't catering to President Trump's desires to crap on the Constitution and keep himself illegitimately in power. What seems to be ignored is that the other eight Justices have concurred on two occasions thus far that the absurd claims of voter fraud, election tampering, what have you, have no merits.

As have all the other courts both State and Federal that have considered this garbage.

You know, some folks always have trouble accepting when their candidate loses. I get that. As I am someone who generally votes against a candidate rather than for one, I understand a certain amount of fault-finding and carping.

Seriously advocating for sedition though? That's beyond the pale.
