Because it’s not speech. Speech has a meaning and a definition.


The SCOTUS has already ruled that flag BURNING is protected by the 1st Amendment as “symbolic speech”. Obviously flag “displaying” would fall under the same ruling. If destroying a flag is protected by the 1st Amendment, displaying one would be, too.

There are and always will be rules to use state property. When is the last time you went to a state fair and had a booth there selling porn? Everyone that uses state [rp[erty has to agree to their rules. Now you could argue being state property it belongs to everyone i get that however even then restrictions on its use to protect the property or the people attending would be required. I know id be mad if i went to state fair and they were selling porn where my kids could see it. Luckily those booths have to approve what they will be selling with the state. However it doesnt infringe on anything they can always choose to say no and sell their stuff somewhere else.

More often than not, Supremes have very strong, and, imnsho, correctly so, inclinations to go their own ways once on the bench.

Once on the bench they are beholden to nothing, and no one, save their own consciences. As it should be.

It will take China to stop creating all the Confederate flags. Cuz yes, the largest percentage of Confederate flags are produced in China. I live in Georgia, used to work some of the flea market circuits and still have a lot of friends who do I know where the supplies come from and I know that most people around here buy some from the flea markets.
