Cuomo signs bill banning sale of Confederate flags

Welp, there goes the whole "1st Amendment".

Like I said, they'll go after the 1st then the 2nd, then maybe the 5th.

ALBANY — Gov. Andrew Cuomo signed a bill into law aimed at banning the sale of “hate symbols” such as the Confederate flag or the swastika on state property — even while admitting the new edict might clash with the First Amendment and be struck down as unconstitutional.

The new law — effective immediately — prohibits the sale of hate symbols on public grounds including state and local fairs, and also severely limits their display unless deemed relevant to serving an educational or historical purpose.

Do you have any idea how annoying this is? I never once wanted to buy a confederate flag, and now I feel like I have to just to prove a point.

OK. I’m confused. How does this possibly clash with the 1st amendment?

It isn’t regulating a religion.
It isn’t stopping anyone exercising any religion.
It isn’t stopping free speech.
It’s not stopping the freedom of the press.
It’s not stopping the freedom of assembly.
It’s not stopping anyone petitioning the government.

While I think it’s a dumb thing to do (why would anyone want to stop anyone buying something, is beyond me), it doesn’t appear to clash with the 1st.

You mean there are people still selling the confederate flag? If you don't make an issue out of it, it will go away all on it's own. I live in the south and I hardly ever see them anymore. Who puts out the flag in New York state, of all places.

One would think Cuomo had better things to do. Kill some more elderly folks. Destroy some more small business. Get some more body piercings. Compare himself to some other useless actors. Hold his kajillionth and one press conference. Stroke his massive ego some more. I mean the list could go on.

Out of all the useless things on this man's agenda, this is the most useless.

But bravo on the virtue signaling. At least half of the population will applaud and proclaim it not only stunning, but brave as well.

"Freedom of speech, also called free speech, means the free and public expression of opinions without censorship, interference and restraint by the government"

"Expressive conduct, also called "symbolic speech" or "speech acts," is nonverbal conduct that intends to communicate a message."

So yes.
Symbols are included in the first amendment.

That I can understand, mostly. Paraphrasing here....

“People can express themselves through art or any other media” so on and so forth.

One could argue that it’s only banned (or at least thinking about being banned) on state property, so “their house, their rules” might (big MIGHT) apply. People would still be able to freely express themselves on the street, at home, at work (to a degree) and so on.

As for book burning? Get off your high horse for once DB. I already said it was dumb, I just wasn’t sure where people thought it would infringe on the 1st.
