Boston Bomber had its death sentence vacated because of a tainted jury with "pretrial publicity exposure" but Roger Stone's jury foreman who expressed explicit bias against him and the President..that's fine I suppose?

“A core promise of our criminal-justice system is that even the very worst among us deserves to be fairly tried and lawfully punished — a point forcefully made by the then-U.S. Attorney for Massachusetts during a presser at the trial's end," the three-judge panel wrote.

They added: "To help make that promise a reality, decisions long on our books say that a judge handling a case involving prejudicial pretrial publicity must elicit 'the kind and degree' of each prospective juror's 'exposure to the case or the parties,' if asked by counsel, see Patriarca v. United States, 402 F.2d 314, 318 (1st Cir. 1968) — only then can the judge reliably assess whether a potential juror can ignore that publicity, as the law requires. But despite a diligent effort, the judge here did not meet the standard set by Patriarca and its successors.”

Stone's judge and jury foreman were real trash. Apparently so is the court of appeals, as the evidence against the bomber was absolute. This virtue signalling might just result in this animal not being put down and the American taxpayer could be stuck housing, feeding, clothing and caring for this monster for the rest of its life.

The Left now support this type of behavior. Burning, killing, looting, it's almost a prerequisite to becoming a member of the Democrat Party now.

On a better note, no matter what happens, that part will never change.

Sorry, I missed the part where Stone was sentenced to death.

Enlighten me.

Once he makes it to Gen pop his sentence will be reinstated.

Just my fantasy but We The People deserve a real trial. I do understand that most don't really want one. It is far more comforting to have someone to blame than to find out the truth.

Has none of you noticed that when ever we have a monstrous crime that we never get the satisfaction of a real trial.

We get suicides. We get guilty pleas. We do not get to hear the evidence.

The Boston Bomber's sentence was mitigated because of a tainted Jury.

So killing people is OK if the Jury is tainted.

Stone had a tainted Jury as well.

But that doesn't matter to you because Orange Man Bad.

You know, the person that you once posted on ATS you wished would die and you had no remorse over wishing that.

Because he doesn't think like you.

So you do your normal mental gymnastics and attempt to point out that there is no similarity in the two trials.

~sigh~

Typed the words slowly and used the smallest words that I could.

Consider yourself enlightened.

Wasnt he essentially a kid?

First offense?

From what I understand he fell into the wrong group... and was somehow ISIS radicalized on US soil.

Life in prison is enough. Obviously his parents and support structure failed him.

It wasn't the sentence but the logic behind vacating it.

I think Lumenari explained it perfectly

Mercy for terrorists? No thank you.

I just regret a needle in the arm is the only way it can be carried out. I'd prefer a rope ala Saddam or an end like Baghdadi cowering and peeing his pants before US ops took him out

No. Murder is not OK. He was convicted of 30 offenses. None of those convictions were overturned.

A new trial will be held for the penalty phase, the part which was vacated. He may, or may not, receive the death penalty but he is certain to spend the rest of his life in prison. Unless Trump pardons him.

Stone is done. He's not going to prison. (Thanks, boss.)

Who said that? Just you?

The conviction is still affirmed. The sentence (death) is what is argued (regarding Tsarnaev).

Stone had a tainted Jury as well.

No, he had a jury of peers who convicted him accordingly for crimes for which he was found guilty

Who?

We should start a ramen noodle fund to the first prisoner to stick his a$$ up.

Actually the jury foreman is provably tainted well beyond mere "exposure to biasing material" this one was an active participant in the partisan games. Not only was she exposed to this material but her opinion was clearly articulated

She also lied and field to disclose this material

I'm hoping someone in prison does the American taxpayers a favor.

Yeah, I've heard that "argument."

Still waiting how Tsarnaev has any relevance to Stone.
