Just so I understand this act, if let's say Nancy Pelosi accused president Trump of a cover up on national TV, then said she wants him in JAIL, that would be a clear violation of the Hatch Act? The decision as to whether removal is warranted is a matter of administrative discretion. Thus, a reviewing court will not reverse the Board’s decision unless it concludes that the decision constituted an abuse of discretion or was not in accordance with the law or was unsupported by substantial evidence or was obtained without procedures required by law, rule or regulation. Kellyanne Conway doesn't seem to know the difference between the job of campaign manager for Donald Trump the candidate, and being an advisor to the President. It's illegal for Kellyanne Conway to campaign for Trump as a government employee. She should offer her resignation, and then accept a position on Trump's reelection campaign.
