Members of the House and the Senate routinely use talking points from their political party while conducting business. They make those statements as part of the process of campaigning to be reelected. Every time they criticize the President it's technically a violation of the Hatch Act. When a sitting President campaigns, they are doing so in violation of the Act.

The real question here is how is the Hatch Act constitutional to begin with? It's a direct violation of free speech.

Every time an elected official is interviewed on air it's technically a violation since elected officials are on the clock 24/7.

Someone needs to drag this through the courts again to get it to the SCOTUS.

Is that what your opinion of the "Hatch Act" is?

That is the basis of this thread btw. Silly was bringing up a law from the 1930s that doesnt apply today and was attempting to show faux outrage over it.

After a few of us actually looked into it and realized that 1st amendment rights quickly debunked her assertions, she bounced out of here.....

Kellyanne Conway doesn't seem to know the difference between the job of campaign manager for Donald Trump the candidate, and being an advisor to the President. It's illegal for Kellyanne Conway to campaign for Trump as a government employee. She should offer her resignation, and then accept a position on Trump's reelection campaign.

The decision as to whether removal is warranted is a matter of administrative discretion. Thus, a reviewing court will not reverse the Board’s decision unless it concludes that the decision constituted an abuse of discretion or was not in accordance with the law or was unsupported by substantial evidence or was obtained without procedures required by law, rule or regulation. The penalty provision in the Hatch Political Activity Act, 5 U.S.C.S. § 1506(a), clearly gives the employer the choice of removing the employee in question “from his office or employment,” or forfeiting federal funds equal to two years’ pay at the rate or amount the employee was receiving at the time of the violation. Further, for 18 months after his removal from employment, federal funds also will be forfeited if the employee is appointed to an office or employment with a state or local agency within the same state.


Penalties - Hatch Act

Looking at the actual report -(direct .pdf link), there are several prior removals listed:

There is precedent for removal due to Hatch Act violations, and at least one of those went to appeal and the removal was upheld.

With regards to Mr. Kerner (the special counsel who wrote the report in question:


Henry Kerner graduated from Harvard Law School and spent 18 years working as a career prosecutor in California. In 2011, he joined the staff of the House Committee on Oversight and Government Reform, the chief investigative committee of the United States House of Representatives. Under Chairman Darrell Issa, and later, Chairman Jason Chaffetz, he led investigations of the federal bureaucracy and fought on behalf of whistleblowers to protect American taxpayers. Mr. Kerner was also the staff director under Ranking Member Sen. John McCain of the Senate Permanent Subcommittee on Investigations, the lead investigative committee of the Senate. He left the Hill in early 2016 and joined Cause of Action Institute as assistant vice president for investigations. Cause of Action is a nonpartisan oversight group committed to exposing waste, fraud and abuse in the federal government. She was also the professional pollster that "confidentially" kept the Hillary Campaign *thinking* it was ahead in all the polling prior to the 2016 election day. (not many people understood that strategy "at the time" and still haven't figured out how she did it) 😎
