Suing employers that hire illegals for "lost wages"

I really want to see some organized conservatives do this.

Get a couple of totally unemployable guys. Drug addicted felons, fresh out of prison with no known work history.

Have them apply for a job at a company that hires a lot of illegals. Fail the interview. Not get hired.

Subpoena the company's worker documentation. Google the names and ID's and prove that some of them are forged. Look for a pattern of bad behavior.

Have the two guys who didn't get hired sue the company for not hiring them.

It would be amazing! I would totally watch the documentary!

Could we call it Arthur season 22 on pbs?

You'd have to show standing that the decision by which felon wasn't hired was itself somehow illegal, and that he wasn't not hired simply because he's a strung-out felon that would be high-risk and wouldn't be a good fit at the company. Good luck

If you can show a company knowingly violated the existing laws by a) hired undocumented workers, and b) violating wage laws you already have means to address it. They need to simply enforce the laws on the books and get tougher with the punishments. I'd be okay with the illegal immigrant suing for his underpaid balance, so the US gets its cut via taxes as well.

This stuff happens a couple ways. I hire someone knowingly under the table for less than minimum wage or knowingly help them beat the E-Verify system with stolen identities because they'll work for minimum wage. OR a guy comes to me with a stolen identity, he's willing to work cheap, he comes up clean on E-Verify, and I hire him.

How do you prove the company was complicit instead of just duped? It's difficult. The under the table work needs to be cracked down on. That's easier to prove, but much harder to find.

Out here in calif they use credit score for hiring.

A bad credit score can be a reason for not hiring.

But the same companies will hire illegals that have NO credit score.

Same thing for work history.

When you are a illegal you can make up a work history in mexico.

They would probably hire the veterans. It's no fun if they actually hire the legal applicants. Then there won't be a law suit.
