The focus of the thread stems mainly on the fact he's caved on the shutdown with no guarantee of a wall in later talks. This goes against his earlier stand where he was clear in stating that the shutdown would continue until he got the funding he wanted, and no less than what he wanted (contradicting dud VP Pence). Not sure how much clearer it could be.

There's a strong possibility he'd get the funding for the wall eventually (and it's likely not going to be the funding he wants, and likely won't be a wall) but it's a possibility nevertheless. He doesn't have any signed agreement or commitment, contrary to all his threats. To date he's got 0$ for the wall. That's a fact.

Yes we're all aware of this. It remains to be seen. It's hard to believe he could rationalize and claim an actual emergency given he came into office 2 years ago and did little to nothing to get the ball moving under both GOP controlled houses. If it wasn't an emergency back then, it certainly wouldn't be the case now. It also doesn't help that the stats for crossings show historic lows with Visa overstayers outpacing illegal crossings for the 7th year in a row.

The whole point of the shutdown was because the Democrats didn't want to negotiate.

The shutdown was started by Trump under the GOP controlled house and Senate. Trump, knowing this full well, said he'd take full responsibility.

Actually, it has been an emergency for decades. Now it has reached the tipping point, and the can can no longer be kicked down the road.

Politicians turned a blind eye to the national security issues involved in unfettered access across our southern border. Now, we have a deadly serious drug, gang, trafficking, child trafficking, and health emergency.

Politicians don't live in the communities where people suffer these kinds of social ills resulting from illegal entry into our country. They live in their own social and residential bubbles free from the unwashed masses.

At first I was annoyed, then I thought about it for a couple of days. This was a good strategy. I personally hope he doesn't use emergency powers as his game seems to be destroy the democrats first, then build the wall. I think he should shut it back down for another month. Then declare the national emergency.

So here's why I think it's a good strategy:
Here are the facts
1) He said he would take the blame for the shutdown over the wall
2) He offered nancy everything she wanted for the wall, she declined
3) Dems were going on vacation and it was getting no coverage
4) Nancy rescinded SOTU to keep his media access lower than it would be
5) Reps passed 3 bills to pay workers during the shutdown, dems voted against
6) McCain 2.0 (Romney) led a coalition of deep state republicans to switch sides

He was being blamed for the shutdown while the dems were being unreasonable and getting away with their unreasonable behavior because we have a democrat run media in this country. Trump desperately needed a large public audience to take his case to. How does he get to them when the media won't cover the dems obtuse actions? SOTU. So trump had two options.
1) Give the SOTU from another location
2) Open the government and give traditional SOTU

The problem with option number 1 is that there's a high likelihood the dem media would not cover it (other than in passing), since it was unconventional. So he opts for the temporary reopening with a hard date on when it will be shut down again.

Now, I'm hoping he used the national emergency talk to lull the dems into a false sense of security. They were never going to do anything on wall funding during this period, but on the off chance that they did, the fact that trump said he'd declare a national emergency should put that on ice. They'll be prepping for that battle. So instead, on february 15th I'm hoping we get a shutdown with plans to not re-open until funding is secured or the emergency is declared. And if it results in an emergency, he should use the shutdown as leverage on another issue.

Let me rewind a little to the upcoming SOTU address. It's going to consist of making the case for the crisis at the border and put the onus on democrats to keep the government open and fund the wall. He will highlight all of their hypocrisy (probably right after, in an interview) in voting for walls and border security. He will make clear all of the facts (dems obtuse behavior) to a public that is mostly unaware of it.

As the time nears of shutdown 2.0 he will squarely pin the upcoming shutdown on democrats. He will reaffirm their previous statements on border security and their funding of prior portions of the wall. He will highlight the drugs/blood/crime the open southern border brings. Shutdown 2.0 will commence. Hopefully for up to 60 days. But at least 45 before declaring a national emergency. At that point he would have exhausted all options. Yes the dems will find a judge to halt the order (isn't it sad, what we've come to), but he should be able to petition SCOTUS for an emergency hearing on the state of emergency where it will be summarily upheld as constitutional and legal.

The president, in order to declare a national emergency, is going to have to choose one. If it's a humanitarian crises/emergency, then the fix is different than if he claims illegal immigration is a economic crisis, and so on.

For example, if Trump claims that there is a humanitarian crisis on the southern border, then a wall isn't the answer. It would just slow down or stop people running for their lives to find temporary solace and/or asylum, placing these individuals at further risk. If it's an economistic crisis, then catching US employers, who are adding to the problem, has to be addressed, beyond a wall. If it's a national security issue, because "bad hombres" are crossing, then it's a border and law enforcement problem, then corruption has to also be addressed, because we know a lot of the bad stuff is coming through border check points.

Whatever avenue Trump uses to use as his case for a national emergency, he'll have to back it up with statistics, to prove the need to bypass Congress. It seems to me, by declaring a national emergency because Congress disagrees and refuses to fund his wall, places Congress in a position, from the adminstration's point of view, of being an enemy of the US's national security and an enemy of the people. That's going to be a hard sell on the Hill, in my opinion.

LOL, that's some interesting gymnastics you're performing. So in your world the president has to declare a single type of emergency and based on what he declares he can't decide what the government does about it? LOL good luck with that theory. It's all three and if he goes by your laid out scenario he's going to get the entire thing fixed all by himself (from wall, to personnel, to technological solutions), then what will the deep state say? Especially when he gets it all without a single concession on DACA or other future dem voter initiatives?

But you're right on one account, congress critters aren't going to like being called out as the enemy of the constitution and US populace that they are. Luckily, that doesn't really matter.

A national emergency can...

1. Stop Immigration completely
2. Provide a solution to prevent illegal immigration
3. Enforce Policy and protect the country

It is all within the right of the president to do this.
