The Attorney General of Kansas is attempting to obtain the medical records of women who received late term abortions to see if any crimes were committed. Phill Kline. an abortion foe, began a secret investigation last October according to legal briefs filed by the clinics that are opposing his effort. The clinics are offering to provide the information with names and addresses removed from the records. The clinics estimate that 90 women would be affected.

The secret investigation began in October, according to written legal arguments filed Tuesday by two medical clinics that are opposing Kline's effort. They are asking the Kansas Supreme Court to intercede, saying if it doesn't, "a woman who exercised her constitutional right to privacy" could find government agents knocking at her door.

Kline, an abortion opponent, scheduled a news conference for Thursday afternoon, and his office said he would discuss "questions raised relating to child rape and abortion in Kansas."

This is really an outrageous misuse of the AG's office and power. Other than the legal witch hunt he seems embarking upon, there is the federal confidentiality law known as HIPPA that also should be called upon to protect the rights of these women. I'm shocked that it has even gotten this far. No doubt either side will appeal to the U.S. Supreme Court if they do not get the outcome they want. If I was one of those women, I would counter sue the AG for breach of privacy etc. etc.

There must be some reason that they are looking. (Rumors on the
street?) They can't just go in without a search warrent and that
won't be issued unless the judge sees something solid. Reading
this article it looks like they have something specific in mind....
child rape being covered up with an abortion, and perhaps the
abortuary destroying evidence of a crime (abortion of the baby
of the child-rape-victim). This doesn't look like a free for all, it
looks like they are trying to go after a child rapist (or two?), and
those who illegally didn't report an underage abortion by a rape victim.

Or am I reading this wrong? I could be, but
that's what I get out of it. If this is the case -
then great .... go after the child rapist(s) and go
after those that covered his(their) tracks just to get
some $$$ by performing the abortion.

First off, i do not posess a yanni, so i will not make a statement regarding the rights or wrongs of the abortion, but i will say that doctors are very good at "cutting thru the red tape" that might prevent a dangerous birth or a child rape victim from having to give birth...

I feel sure that with the limited insider knowledge i have (from being the son of a OB/GYN) that they do not violate laws, but rather "blur lines" so that the spirit of the law is upheld, while helping those in need.
About 90 exceptions for a state the size of kansas seems about right...

i think this will just embarass the hell out of the AG...
the first case he will come up with will be something like a 13yr old raped girl that didn't realize she was pregnant until after the "official" time had expired...

for someone that tries to be the "baby saver" he will probably end up being the "baby killer" for trying to force ignorant child rape victims to have children that could kill them...

and yes, everything he is doing is a witchhunt, where he is assuming he knows more about the welfare of the women than their doctors do...

I was against the government getting into Rush Limbaugh's medical records to "look for crime" and I'm against this. Well obviously I'm against this. Sounds fishy.

like I said religious fundamentalist are getting bolder and with the right influences and money, they are going to get in your bedroom and tell you how yo u should conduct your personal affairs in not time.

The are running rampant and they are intent in violating our civil rights and our right to privacy.

When they get in every bodies bedrooms and start monitoring what you do, and start telling adults that sex life will be regulated then people will do something about it.

Meanwhile they are testing grounds and see what they can get away with it.

This is about privacy and civil rights violations.

You hit the nail on the head in your opening comments. He is an Abortion Foe using his Offical Office as the AG to push his personal agenda.
This is Abuse, pure and simple.
It doesn't make any difference what you are investigating. If you are (or even seem to be) pushing a personal agenda, it's Abuse of Office.
If Kansas has a law to impeach, recall or remove him, they should. Then they should look into prosecuting him.

actually doc, that is an opinion... obviously your title of "doc" doesn't give you any actual knowledge of the topic...
my (step) mother is a very christian woman who opposes abortions on many fronts, but will still perform them when the mothers life is in danger... it is a question of the greater good... ( as well as her job according to the hypocratic oath)

as much as the "right to lifers" would like to ignore the fact: forcing births on women in some situations is actually a "pro death' stance towards the mother... (who. often times, is a vicim of rape in these "exceptions")

i understand your strong emotion on this (since obvously you do posess a vagina) but there are always exceptions to the rule, which is why this is a witch hunt...

if there were truly back street abortion doctors cutting at will, then i would agree with you, but those stopped with the LEGALIZATION of abortions.

I do happen to agree that there are certain women who need to be sterlized as they seem to use abortion as a routine method of birth control... which is just wrong... (even though i dont have an "inny", i can still say that much.)

The article states that the AG gives this reason for his actions:

"I have the duty to investigate and prosecute child rape and other crimes in order to protect Kansas children," Kline, an abortion opponent, said at a news conference.

Excuse me, but isn't a federal law that requires health care providers and others to report abuse cases? So his efforts are redundant, at best.

IMO this is a witch hunt and a case of him using his office to further a personal agenda, as others have stated. It will turn around and bite him in the end.

Excused but for somebody like me that still believe in my rights under the constitution this trouble me as an American citizen in this country and it should affect any other American that value its constitutional rights to privacy.




The records sought include the patient's name, medical history, details of her sex life, birth control practices and psychological profile.



If that is not attempt to take away our civil rights then what do you called it.

These are not abortion at births...
these are "questionable ones' that might have exceeded the time limit by anything as much as a day... they are also not murder, since the roe vs wade decision set the precident that they are unviable outside the womb...

I am all for stopping children from getting raped, but that is obviously not the issue here, since he is requesting records of birth control usage...

he is actually trying to enforce the rule that says that it is ILLEGAL FOR PEOPLE UNDER 16 to have sex... if that isn't crawling into our bedrooms (or backs of cars, in the younger case) then i don't know what is.

It is a witchhunt,
i hope he realizes that just because a 15 year old girl uses birth control pills, it doesn't mean she is having sex... maybe just "womanly troubles".

also, in many states that have the unenforced law about "legal age for sex", they also have a stipulation that states that unless the 2 consenting parties are more than 2 years apart... so that they don't go around imprisoning kids that are just experimenting, but can still prosecute the adults corrupting minors...

i have a feeling an awful lot of teenage boys are going to be up for rape charges just for experimenting with their consenting girlfriends, who got pregnant and were too young to know better. do they deserve to have their lifes turned upside down? not in my opinion... and the poor girls that had to make a hard choice... will now find themselves having to sign a paper that says they were raped by their loving boyfriend...

just one of those very personal issues that should never have been put in a fanatic AG hands...

Abortion doctors have saved a LOT of lives. ...Desperate women who would have gone to real butchers - women who are sick with undiagnosed illnesses that are triggered by pregnancy hormones - girls who were raped and are too young to bring a baby to term. ...and more.

Hitler, Stalin, Pol Pot, etc, etc. sought to control peoples' lives and women's bodies.

FYI - animals know what plants to eat to cause spontaneous abortions when needed - and women knew too, before men called all the village healers witches, killed them off and created the medical industry to fill the gap.

Tyrants, despots, and Land Lords have been trying to control women's bodies, virginity and fertility since the beginning of time. Guess what DrH - it sucks. Big time.

This is my body - not yours or the Land Lord's or the state's. If I feel pain, I know I feel pain and I don't need any medical verification to prove it. If I know I can't carry or raise a child, I know I know.

FYI - I had a child 14 years ago - I spent the entire pregnancy in hospital. My daughter was 3 1/2 pounds at birth. We both almost died - several times. All my organs were shutting down, one by one, but as the medical staff kept telling me, I was really lucky to have such a strong heart.

One of my specialists took on the rest of the team to fight for my right to have a special, expensive test that insurance didn't want to cover. It took about a year and a half, with me near death caring for a newborn. Then another 6 months to get treatment. I was diagnosed with FMD, the hot new disease in 1990. It's off the radar again.

Most women do not have that quality of support. They just sufffer, and make it or die. ...Before that pregnancy I had abortion - and if I had not, I would be dead. I know this now, and I knew it then because my body knew. There was no proof, no medical diagnosis, but it would have happened anyway. Just another unfortunate tragedy.

Pah.

The real kicker is - the same people who want to control women's bodies want to go full bore. Stop women from getting abortions - make women have babies but prevent them from getting welfare - sterilize women who can't cope.

So where do you draw the line DrH, honey? After the patient is dead, broke or over the edge?

Really now then why has the puts AG refused to accept records that has the patients identities removed for his investigation?

As stated above, this is a personal issue with this guy and he is on a fishing expedition. The next step is to get YOUR ISP on the line and see if we have been visiting porn sites on the internet. :shk:
