what else should have been done? throw him out of the courtroom? that would just give him a shot at declaring a mistrial. that whole thing about being able to face your accusers. even if it is the sentencing part i suspect he could still go for a mistrial or have his case thrown out of court for rights violations if they kicked him out. i guess they could have stopped the proceedings for the day. but that would be a huge waste of court time and money. not to mention the time wasted on behalf of the poor jurors having the trial constantly delayed, since it would seem this had been a constant and persistent issue. he might even be able to try to get the case thrown out, or a mistrial based on not receiving a speedy trial, if it kept getting delayed. quite possibly his not shutting up was specifically done to try to get the case thrown out of court. really i think gagging him in such a circumstance was more than warranted. but maybe courts need to be provided with ball gags for such circumstances, instead of tape.

It wasn't cruel, it wasn't unusual.

It was to shut the criminal up.

The criminal showed the court no respect.

That's debatable never mind that the act was more than likely medically unsafe and probably on the wrong side of any health and safety laws.

And the judge did by way of his actions?

Well if so then a mouthy criminal would probably walk away scotfree and sue the state for a good few million $$$$.

Totally agree, but when it ends with duct tape something is very wrong indeed.

If the judge had decided that the defendant was looking at him funny should he also have had the tape cover his eyes?
