That's the easy part actually. They are allowed because we live in a world where very powerful groups of people find such mercenary outlets very useful and they also have the power and money and influence to make it legal. Not only that but they get hundreds of millions of dollars in Gov. contracts and an Undisclosed amount for the CIA for special projects as well.

They are a private army with military capabilities to a degree, but also in ways the military can't or won't get into. Best part is you don't actually have to create a private army. IF you have the money and are the Gov. you can just rent them for special things. It's capitalism at work actually.

It's also allowed because what other choice do you have??
