Man Dies After Cop’s Husband Puts Him In Chokehold Outside Denny’s

Newly released eyewitness video shows the husband of a Texas sheriff’s deputy applying a chokehold to a man who later died.

Houston attorney Jack B. Carroll played the video for reporters on Monday. He said it shows an off-duty Harris County deputy and her husband attempting to restrain 24-year-old John Hernandez outside a Denny’s restaurant, Houston’s KPRC News reported.

According to Harris County Sheriff Ed Gonzalez, the incident occurred on May 28, after the deputy’s husband arrived at the restaurant and saw a drunken Hernandez urinating outside. The man “verbally confronted ... Hernandez about his behavior” and the physical altercation ensued, the sheriff said during a Friday press conference. An individual claiming to have witnessed part of the altercation told Houston’s KPRC News that the deputy’s husband sat on top of Hernandez. “He was punching him in the face, but at this point [Hernandez] was face up,” the witness said. “It got to the point [Hernandez] was struggling to get out, and then he grabbed him [by] his neck [and] he shook him.” The deputy can be seen on the video helping her husband restrain Hernandez. The couple relents once it becomes obvious he’s stopped breathing.

Carroll represents a man who turned the video over to him. He said the man, who wishes to remain anonymous, was threatened with arrest when he made the recording. It was unclear who threatened to arrest him.

dude is kicking his legs and # and cant get away.

There are few context clues here as to the moral fiber of the choker... it's a Denny's in South Texas. I'm in Texas and the guy doing the choking looked real familiar. His type is everywhere... some pent up a$$hole whose d1ck is in constant shade of his beer gut, looking for a fight.

Cops shouldn't even be able to use chokes. It's way more dangerous when a cop does it for the simple fact that if you're in a bjj class youre one on one and can feel when the guy passes out and goes limp plus you have an instructor close by. In the cage youve got a ref. On the ground with a bunch of other cops restraining various limbs with knees in backs etc they're not going to feel anything and the guy is likely to pass out far quicker.

Maybe the bathrooms were occupied and he really had to go.
Maybe the husband should have not said anything and just let it go (bet he wishes now that he would have).
The guy was pissing for gosh sakes not choking someone out in a parking lot which would have/should have led to an immediate physical response by someone to stop a horrific crime (the strangulation) in progress. Oh wait.

I blame Denny's. I ordered once fish and chips and they brought out a plate of fish. I asked the waitress where's my chips and she told me I didn't order any....the menu is fish and chips...I still gave a tip too. Never eating there again. Not for that reason. The food sucked.
