U.S. appeals court revives Clinton email suit

Seems that they are not quite done with Hillary just yet.

WASHINGTON (Reuters) - In a new legal development on the controversy over former Secretary of State Hillary Clinton's emails, an appeals court on Tuesday reversed a lower court ruling and said two U.S. government agencies should have done more to recover the emails.

The ruling from Judge Stephen Williams, of the U.S. Court of Appeals for the District of Columbia Circuit, revives one of a number of legal challenges involving Clinton's handling of government emails when she was secretary of state from 2009 to 2013.

In my opinion the above statement is inaccurate. It should read mishandling of government emails.

Maybe it won't be necessary for Trump to go after her. Maybe the system will do it for him.

No matter what evidence is presented, Clinton will never see a day in jail. She has mountains of money to keep this tied up for years and in her case, any semblance of Justice is a joke. We have soldiers in prison for a picture for God's sake, but she is walking around free and even ran for the highest office in the land.
Thank God and common sense people saw her for what she is.

the allegations are that she had dozens of classified emails chains from different govt agencies.
those emails had to be moved from secure govt computers to the private unsecured servers.
this would involve lawbreaking in several positions in several agencies and would soon turn into an internal $###storm.
and lets not forget barry O had an alias and correspondences on that toilet server.
and if child trafficking was involved, well lets just say, it will be buried

Maybe just release murderers rapists by the thousands, because Republican judge.

Yep that sounds like perfectly sound logic there. The only proper authority is from some Acitivist liberal judge, that believes in legalizing criminal behavior. That's why Hillary Clinton is innocent, because criminal behavior is part of the liberal culture.

It seems that when a certain elevated position is achieved in today's society .... a

person is untouchable, beyond the law of the land.


It's funny how none of those leeches in society, regardless of crimes/fraud ever end

up with a prison sentence.

The fact is people are sick of the special treatment that Clinton received in this investigation. Even the people in "high" places realize this case wasn't handled correctly.

You're mistaking "criminal wrongdoing" with the Justice Dept.'s unwillingness to prosecute.

Clinton did in fact break the law. It's public record. She wasn't prosecuted because she "didn't intend" to be a criminal.

That's incorrect. The allegation is that information contained within the emails was classified not that the emails originated on classified systems.

Charges need to be filed, and criminals prosecuted.

If an army private can go to jail for mishandling classified information, then she needs to spend life in prison for how she handled it. It has nothing to do with party affiliations, or who thinks this is akin to "beating a dead horse". The woman is a criminal, and should be treated as such.

It's pretty bad this has been quiet lately.

According to the President-elect, a judge whose parents immigrated from Mexico is incapable of fairly presiding over a case in which he is a defendant. Did you disagree with that?

Here's one for you: do you know who Elliott Broidy is? He confessed to bribing disgraced former NY controller, Alan Hevesi, who was also taking money from Donald Trump at the same time? Broidy was appointed vice chair of the Trump Victory Fund despite his recent criminal past.

I cannot believe that after all this time, media coverage, thousands of threads on ATS, etc — a large swath of you still don't even understand at the most basic level what it is that you're outraged about.

Some part of the information contained within the emails was classified either at the time it was conveyed or retroactively classified at some point afterward. That could be just about any information that was deemed by a classification authority to merit secrecy.

For example:

Let's assume that Alice works at the State Dept in DC, Bob at an embassy in Madeupistan and Chris is an officer in the CIA. The CIA doesn't want anyone to know that Chris is headed to Madeupistan. When Chris arrives in Madeupistan he talks to Bob at the embassy. Bob sends a diplomatic cable to Alice that makes a reference to Chris's arrival. Bob has just communicated classified information to Alice. Alice reads the cable and then later in an email about Madeupistan to fellow State Dept employee, Eve, sent to her Gmail account, Alice mentions to Eve that Chris has arrived in Madeupistan. Alice has just communicated classified information to Eve — even if she wasn't aware that the information was classified.

The issue isn't that classified communications were somehow forwarded from secure systems to a private email server — because that's not what happened — but rather that classified information (Chris's arrival) has been communicated through a private email server in violation of security protocols designed to protect that information.

Then you must also believe that Gen. Petraeus deserved life imprisonment? After all, he revealed classified information to a woman he was having an affair with. How many state secrets have been leaked via pillow talk? I'm pretty sure they cover not divulging classified information to people your screwing on the first day of How Not To Handle Classified Information 101.

How about the new National Security Advisor, Lt. Gen. Michael Flynn? He inappropriately shared classified information with Pakastani military officers (about CIA operations). Shouldn't he spend his life in prison too?

That "lock her up" chant/meme has always humored me.

She would never see the inside of a jail cell even if they did decide to indict her. Either she would plead guilty and get a slap-on-the-wrist misdemeanor, or the court finds her guilty and has a great appeal case based on equal application of the law.
