I am sure Comey knew exactly what he was doing. He was in a hard position, and I think that his move was calculated and genius.

What were the alternatives? If he recommended indictment, he could never have said what he said in that press conference. At that point it would have been an ongoing case, and it would have been considered compromising the case to go into such detail and make such harsh comments and conclusions. He would have had to keep his mouth shut. Then the prosecutors would either drag the case out far past the election, or immediately close the case, and either way he would have been gagged.

So, he used his one opportunity to carefully word a press conference to counter her lies, one by one. He blatantly stated that she was at the very least incompetent. He gave the public a chance to know the truth, instead of sending it to get buried by prosecutors.

I'm not sure if he was ordered to the final recommendation or not. But either way, I'm very sure that Lynch and Clinton never expected him to go public with the rest of what he said.

Now he put Congress in a position where they might be able to order a special prosecutor. If not, at least the charges can still be made again in the future, perhaps under another Attorney General, if Trump is elected.

I think this was the only thing Comey could do that would have any repercussions on Clinton. He knew she was guilty - he stated it outright to those paying attention to exactly what he said. He probably knows way more than he said. So, he took his best shot at justice.
