a taxi is a 'public place". In a public place you have no expectation of privacy, and therefore can be recorded. end of story.

I hope the taxi driver files a countersuit.

And exactly which court cases have held that "a taxi is a public place?" I didn't think so. Every court of record that has considered the issue has held that a taxi is NOT a public place. Otherwise, the police telling people to take a cab home if they are too drunk to drive would be entrapping people into criminal activity - drunk in a public place. And the taxi driver can't file a countersuit. He filed the original suit. Under the Rules of Civil Procedure, the allowed pleadings asking for relief are limited to a complaint, a cross-claim, a counterclaim, and a third party complaint.
If you are going to play lawyer, go to school for 19 years first and get a license so you don't hurt people with stupid advice.
