Judge REDUCES prison sentence of man who raped 3 yr old while covering her mouth

He didn't MEAN to hurt her!

A California judge has reduced a child rapist's mandatory 25-year sentence down to only 10 - saying anything longer would be 'cruel and unusual punishment'.

Superior Court Judge M. Marc Kelly told an Orange County jury that 20-year-old Kevin Jonas Rojano-Nieto 'did not intend to harm' the three-year-old girl he raped at his family home in June.

The judge said that he was sure that although Rojano-Nieto sodomized the girl and covered her mouth so she couldn't scream out, 'there was no violence or callous disregard for the victim's well-being'.

Judge Kelly also said Rojano-Nieto, 'inexplicably became sexually aroused but did not appear to consciously intend to harm the victim.'

Prosecutor have said they will appeal the controversial decision and will be pushing for the minimum sentence of 25-years to life to be reinstated.

Aww c'mon guys! It was an accident! She was asking for it walking in front of him while he was playing video games. Who did that 3 yr old think she was! That little enticing minx! They start so young. /Sarc off.

This is somewhat the same crap I heard when I was 7. I was asking for it. Therefore he got 6 months probation. THAT was in the late 70's. I see we STILL haven't grown up. Shame shame! Sad to see the same judges are in business and still behave as if children are responsible for grown men becoming "inexplicably aroused", as if men just cannot control themselves around women and children. I don't know whether to feel blessed to have such power, or sad to know men are so powerless and helpless.

Ten years for any rape is a very light sentence, but rape of a child calls for a beheading in my book.

I can't really even safely comment on this situation... I will try my best. I was appalled when I read the article.

There is nothing... NOTHING that can happen to this man that I would consider cruel and unusual punishment. ABSOLUTELY NOTHING.

I guess the judge just conveniently forgot about the lingering memories and destroyed innocence that this girl will have to face for the rest of her days.

That is all. Because anything else will be going too far.

As a mother... I am beyond pissed.

I'm just glad I do not have girls...

I would be in jail a long time if this happened on one of mine, and happily accept my fate.

Pedophilia is incurable, it should be a life sentence in all cases like this...They do not stop...ever.... when given the chance.

I'll be surprised if he lasts a month in prison.

My gut instinct also says that the appeal will go through and his original sentence will stand.

Why? Because this hit the news. The population may be somewhat lazy as all get out but NOBODY likes pedophiles. Not even murderers in the penitentiary. There will be a public outcry on this and it will force the hand of those who make these decisions.

There'll not be another judge, or jury who will want to be held responsible for this sick, sad, waste of human flesh getting back out one day early only to reoffend.

You have to wonder if the judge has gone insane, stopped his meds or is just trying to help out a fellow with similar twisted interests? It really does make you wonder.

Beyond sickening. Guess he won't accept the reply of "they didn't mean to hurt him" when he gets his. But you know they rarely do. Just the type of judge who supports these elite rings running rampant even on WS. Put them both in the woods and let the wildlife take care of them.

Oh... And I hope this sick, sad, waste of human flesh judge has his freedom revoked (In one form or another) ASAP for making such a deluded, callous, and evil decision. The man has no business within a five state radius of anything related to "Justice".

This is exactly what I thought when I read this. I am completely flabbergasted that anyone, least of all someone whose job it us to put away pieces of crap like this, would find that it was no done with violent intentions. Its disgusting that we women have to prepare to defend ourselves against rape because some men "can't control themselves"!!!!

Luckily, none of my daughters had these issues.

I made sure that everyone I come in contact with knew what the hell I would do to them.... In a joking, not so joking way of course

Since "most" of these incidents happen with people you know, I made sure they knew exactly what actions I would take in such a matter.

Talking about "fun with vicegrips" is a very effective deterrent it appears.

Check under his mattress and his computer for the pedo porn videos. Judge just appears way to "sympathetic" with his "justification statements" to me.

Since I did I will be dead honest. If anyone did that to my child they wouldn't see a day in court. To hell with the consequences, but if by some chance the police picked him up before I got to him I would be waiting for him when he got to carry out a real sentence.

I will refrain from speaking on what I may be inclined to do as far as the judge. It is better to not leave a trail, but there was a movie about something similar.
