Austin Smith Clem, 25, was convicted in September on one count of first-degree rape, two counts of second-degree rape, and two counts of second-degree rape for sexually abusing a girl at 13, raping her twice at 14, then raping her again at age 18.

First-degree rape is a Class A felony and therefore punishable by 20 years to life in prison. Each second-degree rape charge is a Class B felony, which could cost an offender anywhere from two to ten years behind bars.

He was sentenced Wednesday to time in a community corrections program instead of prison.

Brian Jones, the Limestone County district attorney, claims the sentence imposed by Judge James Woodroof does not follow the law. He reportedly stood up in the court room and yelled at Woodroof, saying, “This isn’t legal. It’s not a legal sentence.”

We see all the time that the justice system is severely flawed... But apparently, in this case, the judge even gave out a sentence that would otherwise be illegal to give through a small legal loophole.
A guy repeatedly rapes a teenage girl over several years and gets probation... One has to wonder if the judge was a sympathizer towards this man's crimes.
Hopefully there will be proper justice for this girl.

The justice system is not flawed, it simply is INSANE AND NONSENSICAL WITHIN ITSELF. The very foundations of the US justice system is based on unfair, and ineffective judgement.

It is not about the truth, or innocence, period. This has been reiterated time again.

There is no sound, ethical basis for judges to be judges. We have racists, pedos, idiots, criminals, the worst individuals of society in these positions. Letting people go or lightly punishing them for straight up murder or rape, while sentencing first time drug offenders or victim-less crime offenders 10 years and up in prison.

The very basic, fundamental concept of slapping somebody with 500 YEARS ON PRISON, AND ANOTHER 5 YEARS FOR GOOD MEASURE, is empirically, within itself, crazy enough to make the average thinking brain explode. What is the point of this? For what? Who is living 2 consecutive life sentences? And then another 5 years?

The government does not want to fix the justice system. At all. It was made to be crazy and insane for a reason. To make us all crazy and insane.

Second Degree Rape - a person is guilty of rape in the second degree if the person engages in vaginal intercourse with another person:

By force and against the will of the other person; or
Who is mentally defective, mentally incapacitated, or physically helpless, and the person performing the act knows or should reasonably know the other person is mentally, or physically helpless.

If he was sentenced to just statutory rape, which may or may not be consensual...it would be labelled so.

In this case he had been raping the girl now woman through teens and then adulthood (18).

Do the math, she's now 20, meaning he was 17 or 18 at the time of the first assault.
Also, if you are under the age of consent, you are legally incapable of "giving consent".
