"Revenge Porn", outlawed in California. Is this a First Amendment Issue or not?

It should have always been illegal to post nude images of people without their consent. If you allow a lover to photograph your breasts or penis as a momento between the two of you, this doesn't mean that image is something you'd like your grandma to know existed. It doesn't make it public property.

Too many predator minded excuses on this topic here. Don't blame me if I break your trust, it was my pleasure.

Privacy is privacy, doesn't matter if it is financial information or your own body.

Lets keep making new laws for the people who refuse to except the consequences of their own idiotic actions.
Makes sense to me.

It's a privacy issue. Just because someone shares something private with someone doesn't grant them permission to make it available to the world.

The only reason I can think of someone being against this is because they support it or enjoy it.

Show me *one* place where privacy is actually protected by law.

You asked for a law that protects privacy...I gave you one...now you want to move the goalposts.

The Health Insurance Portability and Accounting Act covers the matter of a person having a photograph distributed much like the seatbelt law addresses drunk driving.


Apples & Oranges.

If you have a problem with that logic, well.......

Unnecessary laws vs personal responsibility, that's what I have a problem with.

Both my children (boys) were raised well. One just graduated college and the other is a sophomore on a sports scholarship at a D1 school. Good boys. That doesn't mean they didn't give me hell for a few years as will yours. They do rebel. All of them. Girls and boys.

Really the person who looks the worst is the one who publishes this type of stuff, that doesn't make it any less harmful to the victim.

It is sad that there need to be laws to enforce common manners.

Since the time of letters if you break off a friendship each party would return the letters and or gifts that the other party wrote or gave.

My Mother always told me, "Don't write down anything you wouldn't want the world to read".

People should know that in today's world, ANYTHING you record could wind up on youtube......or worse.

There is NO such thing as privacy anymore.

Thank goodness because this is a complete violent and horrendous hideous crime and against their free will.

There are many people that have been photographed and or filmed without their knowledge. It sickens me that there is no such thing as a right to privacy anymore. A merica has become the "Enquirer". When something is said or portrayed, the damage has been done and there is no going back.America has become the land of the free to stab people in the back.This conversation wouldn~t exist 50 years ago because we had values and pride in ourselves and our country. In order to survive we need to stick together.

Unless the understanding between the two is that they can be publicly disseminated, then they have no right to do so. You can curtail free speech under contract, which is what such an agreement between spouse/husband would be.

No. It is not free speech. I would consider it more akin to slander, although the wording of that law is not quite right for this.
