If you make snap judgements like this about Amanda Knox, then you probably do the same to everyone else.

Which can only lead one to wonder how many times you have carried out your own little vendettas based on your belief in your absolute ability to judge the guilt or innocence of others.

I have read the thread and I have also read many, many reports and articles

on the case. There are no facts only the reporting of events from many different

sources and 'nationalities' and each one from their own perspectives ( a whole day

in court equates to a double page spread?)


I don't think you are in a position to know any more about the facts regarding this case

than anyone else on this thread (not unless anyone else was actually in the courtroom)


The tabloid press in Italy is no more biased than the American press, or the UK press, or

the press any where else in the world.


Italy have their own justice system like any other country...but just because it's

different from the US doesn't make it wrong, and facts don't show 'it's corrupt to the core'

One corrupt member (who I believe has been dealt with) doesn't equate to the 'whole

judicial system'
....Corruption is not the sole prerogative of any one country, it can

be found any where, even in the US

were all those people really staying at the same hotel - the reviews were so vastly

when the prosecutor in this incident is let go, and attempts made to prosecute him for abuse, then I will develop more respect for the Italian legal system.

I don't have much respect for the one here in the states, but it isn't as bad as the Italian system from looking at this case.

I cannot speak to the validity of the system in Italy, but I do not think people are saying their system is wrong. The instance in which many Americans see it as such is because we understand a few basic principles that we enjoy: double-jeopardy being one. So seeing one our own citizens, being subjected to an Italian court willing to continue the trial, even after a jury found that person innocent, is reaching.

Very true; hence why many are even jaded on the system employed (which isn't that different than Italy) in the United States. To put into perspective, I would be harping on the likes if it were an American case such as whats-her-name from Florida. The jury found her innocent even though many thought she was guilty. It matters now what the "public" thinks, only what the 12 (in the case of an American jury) thinks. In essence, it is a very sacred understanding that we are innocent until the State itself and a jury of our peers can prove otherwise.

In this case, Amanda Knox could not be proven guilty. Her innocence, may it be valid or not, holds.

It matters not in a court room. Puzzled indeed. In modern Justice, a person is innocent until the State or the offended party can prove otherwise. In this case, the State failed miserably with piss-poor conduct and questionable motive. The notion that there was "no facts to prove she wasn't involved" holds no bearing in the court of law.

That type of thinking makes me wonder if you are for people having to prove their innocence (such as many have done in very restrictive nations such as the USSR, North Korea, East Germany) against the State who has all the power of arrest and prosecution.

If there is new evidence, that was improperly handled by the court, then yes, a re-trial is in order. If it is evidence that is happened upon or even old evidence that they suddenly want to admit, then no.

Whilst I know no more than anyone else on this thread I think there are

many assumptions being made in that post and I pointed this out. And as everyone has

only had what has been in the media to form their opinions on, mine are no less valid than

that of anyone else


In the UK the criminal justice act of 2003 a retrial can be ordered where there is new and

compelling evidence. This came into force in 2005 and at least two people have subsequently

been convicted for crimes that they were previously acquitted of. Although this is only true of

England and Wales. Scotland and NI both still operate the double jeopardy rule.


Here in the UK in 2012 new evidence convicted two men of a fatal stabbing, for which

they had been acquitted of 18 years previously!....(google Stephen Lawrence murder)

US Citizens have shown beyond doubt, both here on this board, and in the celebrations they held when the murderer Knox was released, that they view our legal systems with contempt. They have demonstrated an attitude suggesting they feel they are above the laws of European nations, and as seen here, are willing to revel and celebrate in this theory. As such, I suggest that all US citizens should be banned outright from entering any EU country for any purpose. There is no reason for a US citizen to be in the EU in any case, and your being in EU nations causes nothing but discontent for the residents of said countries, so I don't predict any opposition to this idea.

Justice is a curious thing here on ATS. People, regardless of the case at hand, enter in with highly subjective views and apply their views to what justice should be.

Case and point: Amanda Knox was acquitted by a jury of her peers. The State failed to prove that she was the murderer. In one corner, some here have stated that she is free and clear (which shouldn't be equated to innocence by the way) and others have stated that she should be retried again and again until their "justice" is achieved. The later here is not justice, but mob-mentality. The State must prove guilt, otherwise anyone can be snatched up and convicted at the whim of the State without any due process.

Now, in my world view of justice, the later is dangerous. It gives the State unlimited time to continue the pursuit of someone just because they have a feeling or that they were not able to achieve their desired goals the first time around. That is the basic premise of double-jeopardy and the concept of innocent until proven guilty.

We are not talking about a hung-jury here. The jury did not find the State's argument against Amanda Knox to be compelling enough to prove her guilt. Like it or not, she was given due process, was subjected to State evidence, and they failed to see guilt. That is justice.

On a side note: I reread your analogy and apologize as it wasn't directed towards the case; rather, a post.

Prosecutor Mignini's story is preposterous. How the Kercher's could fall for such an impossible story is beyond me, but perhaps the same flawed family mindset is what led to Merideth's death.

Even if she is convicted, she has such strong support that extradition would be nearly impossible. Worst case scenario for her would be a travel ban.

Gloat all you like, but in the end the story will end and nothing will change.

Refusal to extradite would be seen as an insult to all Europeans and the response would be strong. I would suggest imposing eminent domain to remove US bases from EU soil, a complete ban on any missile defense systems and imposing a large tax on any US imports should be enough.

Failing that, we could just lift any embargoes on Iran and allow them to rebuild their military, allowing oil to be sold in vast quantities at extremely low prices, causing Saudi Arabia to lose business and an energy crisis in the US.

She will be extradited, and she will be punished. I can't wait to see her sobbing her sordid little heart out as she hears she will never see her family for decades.

Me personally? I'm using a laptop, itself a development of the British invented electronic computer, which was made by a British company, manufactured in China, running Linux which is Finnish. This is the WWW, an English invention, by a Sir Tim Berners Lee.

Nice try though.

One day your country might actually be able to invent something on its own, unlike your usual method, which is just to steal it and credit it to yourself.
