Indiana child support: Child support demanded from sperm donor

The state of Indiana has demanded that a sperm donor pays child support. Complicating the issue is that the state of Indiana doesn't recognize same sex unions and so refuses to seek child support from the mother's former lesbian partner.

In a contract signed by the couple and the donor, the donor agreed to donate his sperm in exchange for a guarantee that he would have no financial or parental responsibility for the child. Now that the couple has split up and has asked the state for financial assistance, the state is looking to the donor to pay child support.

If this state prevails in their argument, sperm donors could be held accountable for child support to women who artificially inseminate themselves and then ask for child support from the donor.

Child support issues can be complicated enough, but a case such as this could be a potential disaster not only for same-sex couples in Indiana, but sperm donors as well. Men may become hesitant to help same-sex couples have children if they believe they could be made to pay child support.

This seems unfair.

This Indiana case follows a ruling in Kansas in which a sperm donor was forced to pay child support for a child he fathered for a lesbian couple.

It's amazing that a guy would create life without a contract or any forethought. I don't think he should be required to pay whatsoever if he can petition Craigslist to furnish a copy of the original ad and his email response, he should be clear.

I don't know about the Indiana Case, but there is an important detail that needs to be mentioned in regards to the Kansas Case.

To be clear about it, I personally still think it's a load of BS, but it is an important part of that Kansas Ruling. I'm not gonna paste it all, because I read some of this in a different article, a week or so ago, but basically....

He put it in a cup, and dropped it off at their house. IF they had used a Physician, it would not have turned into an issue for the guy.

Indiana is is becoming worse than Kalifornia. First it was with LEO's not needing a search warrant to enter your home, and now this. Their Child Support Courts are the worst in Amerika.

It's a shame really but, the guy messed ;up and should've had everything written down on paper. It would've saved him a lot of grief.

I hope he doesn't have to pay, IMO it's sexist in a way, it's telling me that just because he's the man he has to pay. IDK, this is a touchy subject.

I think that you and I both, are just going off of memory of what we previously read, so I'm not making any guarantees. I know I read it an online article, and not a thread, but that doesn't mean it's true.......

Anyways, I'm pretty sure it was Craig's List. They paid him. He filled a cup, and then dropped it off at their front door.


I know I would never use 'Craigs List' to find a random incubator to drop my seed into. Maybe he should've thought that through a bit more.


Really though, nothing about this is the least bit surprising:
2 Lesbians screwed over 1 guy.... Gee. Yeah, that's a real curve ball. No one could have possibly seen that coming....

This is really sad. And, IMO, very wrong. Unfortunately, if you're going to have a contract, you have to go through legal means of making it 'stick'. It's a lesson some of us have to learn the hard way. Writing up a "contract" means nothing unless the law/state is involved.

We loaned a "friend" a LOT of money under a contract we penned. Since he was a "friend", we didn't feel getting the law involved was necessary. Well, that was 6-7 years ago and the guy never paid us a penny. He took the money with the scam in mind... We took it to court, but it got so involved and would be so expensive that we just marked it up as a learning experience. I'm still angry about it, but we did learn.

Men have to be CAREFUL these days. Going through a qualified sperm doner is the way to go. If you want to help your friends have a baby, take them to the sperm bank and do it that way.

I feel for the guy and hope he can get around it somehow. The laws there are very specific and apparently the women knew that and yet they took his sperm anyhow. I wonder if they could be charged with unlawful coercion, I mean he didn't know this could happen. He thought he was doing something good for good people. I understand that ignorance of the law is no excuse but the guy was being nice, this is terrible.

If anything I hope the hags are made to feel bad by their peers for this.
