the tv licence officials have no legal right to enter your home to check if you have a tv .

there are no tv detector vans they are an urban myth .

the only way they know that you don't have a tv licence is because they presume that every household has a tv
and if there is no record of a licence at your address you are automaticaly presumed to be guilty .

they need proof that you have a tv and that you watch it and the onus is on them to provide the proof .

I think the idea is if you do not give your name, you cannot get invited to court, therefor you do not get fined.

You cant get a court summons if you don't tell them who you are! If they then try to ascertain your identity by other means they are breaching the data protection act of 1988.

Ah what a coincidence, I recently had a visit from the TVLA Gestapo, sadly I was out so the twat give my son a hard time with threats of court action and mutlimillion fines if I don't pay up, needless to say I was mighty pissed when I came home to find my son all a flap.

I haven't got one of their licences in over ten years and if the British public developed a spine and declined the state invitation to pay a tv tax then life would be a lot simpler.

After I arrived home and found my son panicking I phoned up the TVLA like the dude in the video and after some messing about finally got hold of someone claiming to be in authority.

I pointed out that as they were recording the phone call for "training and security" purposes so was I, I then proceeded to inform then that for the purpose of the phone call I would be using a ficticious name Mr Smith,

I then informed them that I was revoking their "implied right of access" and should any other TVLA agent come to my home I will treat it as willfull trepass and "Hold" said agent until further notice.

I asked the guy on the phone to confirm that he and his department fully understood what I had said and repeat to me that I would hold any trespassing TVLA agent, which he did.

This was about 3 weeks ago and no agent has returned, I have however recieved 2 letters from the TVLA which I mark "NO CONTRACT RETURN TO SENDER" and have slung them unopened back in the post which they will have to pay for.

Ive never heard so much arse talk in my life, Yes they provide a service, BUT I DONT WANT IT. so it IS extortion.
its like having pirelli tyres on your car but every year you have to pay goodyear £120!!!!!!!!!!! or they come to your door and harass you with threats! Times have changed, We dont doff our caps to the all mighty BBC anymore.
They are an outmoded propaganda wing for the UK PLC.Why should i pay for that?

Excellent mate i'm proud of you! Way to tell em! I would add be carefull threatening to detain people especially in the current climate and when your are being recorded. That could go bad very easily IMHO.

So can you confirm you have been made to pay the License Fee despite not using their service? I'm guessing not...in which case its not extortion, its a reasonable measure to catch license-dodgers.

If you don't want it, then you don't have to pay it - if you are one of the people they might happen to visit to double-check this then you can confirm that to them any way you feel - it's already been made clear here that they cannot force their way into your home.

No one is forcing you to pay the fee, no one is forcing you to watch / listen to BBC programmes, no one is even making you answer your door to inspectors.

Now, if you object to the principle of inspectors - that's quite a different matter - but they are simply aiming to minimise the likelihood of people avoiding the license fee when they use the service. We both know there are people who try to avoid paying the license fee - calls from an inspector are quite a reasonable way of doing this.

You cant blame Curry's i'm afraid. They have to inform the TVL of any and all transactions involving a TV. The same as every builder who builds a new house, TVL have to be informed of the new addresses, so they can send them a threatening letter. I didn't fill in the census when it came round, i wasn't going to do a treasonable offence and give my details to a foreign company/government. They haven't had mine nor are they ever likely too.

Well i have to say i'm with the previous poster. BBC sold out the F1 to Sky when they didn't need to. deadenders, about the worst prog on tv, only fools, hasn't been made in donkeys years, Dr Who, sorry new one doesn't quite do it. when was the last time the beeb did a really good Attenbrough ?

I know, it's funny how they have the right to assume everyone owns a tv and watches live. Just another octopus allowed to spread its tentacles everywhere.

I heard the census was gathering info for other governments and what not. Why is that? I could understand the audacity of our governments doing it but seems odd to say the least, that foreign governments would collect personal data and state you "must" under act such and such.....

The UK census was run by Lockheed Martin, the largest defense contractor in the world and based in the states. Now the Patriot act allows the US government to demand and see any details stored by a US company on their servers, doesn't take a genius to work out that all those census details are stored on a US based server, ffs the web address for doing it on-line was owned by LM.

It's amazing how many people thought i was paranoid

Sounds like they want to keep tabs on everyone, nosey gits.

We really are just treated as stock logged into sytems.

The name of the person which is not the human has willingly been handed over to these census collection officials. Makes you wonder how valuable that name really is, And what they really want them for.

I always picture some little old lady sitting minding her own business in her own home.When some jackboot tosser bangs on her door at 8 oclock at night, and scares the hell out of her with threats of a thousand pound fine,
if she cant produce her tv license. This is how these bastards work. fear and intimidation are there tools.

It's ok dude, I didn't threaten to detain I instructed them clearly that should one of their Agents return and "Trespass" on my property having been clearly instructed not to, I would "Hold" him/her. I have every right as a citizen to perform a citizens arrest especially in relation to knowingly trespassing onto my property in order to harrass and possibly obtain money by deception. There is also the matter of the agent having intent to cause breach of the peace having previously been instructed that any implied right of access having been revoked.


The facist bastards from the Census office got the same deal I put a sign up at the frront of my drive informng them it would cost them to speak to me, never saw them again.

This business of entering into contracts and all that is quite interesting. Not long back I was forver getting useless bloody advert texts on my mobile from Orange,. Time and again I asked them to stop but they just kept coming so I phoned them back up and told them I was recording the call and asked to speak to someone senior. I told the bloke that I was fed up with their text and had yet another promise that they would stop. I told the guy I didn't beleive him and would now be charging Orange to delete any further text messages if I got any more then they would have to pay my costs..

The Texts still kept coming so I phoned Orange again demanding payment for deleting their texts, my rate was £10.00 per text £50.0 total which they in all fairness paid and credited the ammount to my account, a pay as you go which I barely use £5.00 in 2 months.

Needless to say I never got another unwanted text from Orange, now we all know where we stand.

Fortunately that was the last ever census but I do have my concerns about the reason why, perhaps TPTB are so confident they'll have the UK so locked down in the future that they'll have all our info at their disposal via anothor route, or perhaps I'm paranoid.

I think the best way to deal with debt collectors is to endevour to avoid debt at all costs to begin with, easier said than done in a society designed to keep us in debt I know and the UK peeps are so intent on becoming like the Americans there seems little hope of avoiding financial serfdom.

It's so crushing to think that our neighbours can't even find the courage to say no to their needy offspring let alone to the state muppets.

Treaspass is a civil offence, not a criminal one, and is therefore, non-arrestable.

If you detained a TVL Inspector for trespass by making a "citizens arrest", you would be guilty of false inprisonment, since its not arrestable. The most you can leagally do is instruct them to vacate your property immediately, and by the shortest route. If they refuse then all you can do is call the police, and have them physically removed.

Not even the police can arrest for trespass, only escort the trespasser to public land.

This is why a "little knowlege" is more dangerous than "no knowlege" sometimes.

Also to clarify some other points.

Any person or company selling a TV reciever or recorder, have to inform TVL of the sale. this is a legal requirement. That means they even have to report the sale of dvd-recorders, PVR's etc. Sadly Tesco and other companies automatically report the sale of any visual equipment, just to cover their legal arses, even when they are not required to (eg, dvd players).

TVL have sub contracted their enforcement and collections to a private company called Capita, who operate on a commission basis, and that makes them very pushy. That is, they get paid for each person they catch, and paid even more if they persuade that caught person to buy a TV Licence (even if one isn't required).

Capita acting as a representative of TVL, CAN and HAVE apply for legal search warrants if you try and take the revocation of implied access route, it doesn't often happen, but it is something to be aware of. Once they have a search warrant, they are coming in, like it or not, and nothing you can do will stop them.

A lot of Magistrates misunderstand TV Licencing laws, and fine people who didn't need a licence, for not having one. Anyone in such a case has had the fine overturned by Crown Court, but not everyone appeals.

However, your thoughts pleas - I did state "knowingly harrass and obtain money by deception" and from experience I''ve obsereved first hand the make it up as you go along attitude toward "breach of the peace"

Of interest - I have noticed a change in the wording of TVLA literature, they now inform the reader that " A licence is only required for recieving programmes whilst they are being shown on TV"

To my mind this is a whopping big turn around from owning an item capable of recieving a transmission and makes it quite clear that the burden of proof is on TVLA , perhaps with their magick vans.

I may be wrong here but last I heard, the collection of information by the likes of Tesco et al for TVLA either has been or soon will be dropped.
I notice Aldi and Lidl never once collected the information, I had a huge row with Tesco and reported them for taking my details from my credit card and passing them on to a 3rd party (TVLA) because I gave fake details to begin with. Turns out they got clobbered by the Data Protection Act and I had an appology. They were also forced to accept that a scart lead cannot by itself allow mee to watch BBC programming,. Yup you read correctly a fricking "scart lead" for my mums old VCR which I returned because it was faulty !!!
