I don't think Kissinger has been formally indicted on war crimes charges by the ICC. This is probably due to legal technicalities and to pressure
brought to bear on any who would seek to have him indicted, by the US government.
Formal indictment is the big hurdle. Once a person is indicted, it would be very difficult for a government particularly one that talks the talk that
the US talks, to fail to hand him over to the court.
At some point it is no longer cost effective to shield a war criminal, even for the US.
The case of Arthur Rudolph, the Nazi scientist and father of the Saturn rocket is an example of someone shielded until he was no longer of importance
and then sent to face the music.
