Chris Hedges a foreign correspondent, author and activist, including heavily active in the Occupy Movement is one of several plaintiffs who brought a lawsuit against President Obama and members of his Administration. This week a Federal Judge ruled the provision beyond the scope of The Constitution.

Here's an interview in which Hedges who sat through the case in the plaintiffs seat, describes the Governments defense testimony and makes, in my opinion, the only logical conclusion that can be made. Section 1021 was meant to silence dissent.

Partial Transcription-
CHRIS HEDGES: That’s what’s so interesting. None of the Pentagon, the FBI, as you—Mueller and everyone else, as you pointed out—none of them supported the bill, even to the extent where Mueller and others were testifying before Congress that it would make their work more difficult. And yet it passes anyway. And it is a kind of—I think it’s a kind of mystery to the rest of us as to what are the forces that—when you have the security establishment publicly opposing it, what are the forces that are putting it in place? And I can only suppose that what they’re doing is setting up a kind of legal mechanism to criminalize any kind of dissent. And Bruce can speak to this a little more. But in the course of the trial, with Alexa O’Brien, US Day of Rage, that WikiLeaks dump of five million emails of the public security firm Stratfor, we saw in those email correspondence an attempt to link US Day of Rage with al-Qaeda. Once they link you with a terrorist group, then these draconian forms of control can be used against legitimate forms of protest, and particularly the Occupy movement.

I couldn't have said it better. The Corporate, Authoritarian, and Fascist Right should be worshiping Obama.

Well, perhaps they actually do. It would be to their advantage to pretend to be mortal enemies, though.

What we're seeing is the beginning of the end game. It's us or them--and they're obviously terrified that they won't get their plan in place before we tumble to it. When I say us, I don't mean just the 1% or 2%--I mean enough of us to see them in the dock for their treason. We better bring our best game....

I totally disagree this was particularly MADE for the Occupy movement.

This is for ANYONE who opposes tyranny .

Kind of Presumptuous to think,Obama and the Law makers, saw the Occupy movement as the reason to enact this bill.I could easily say this was for the gun toting Tea Party........

It affects all of us. Not a percentage.

Well said and thank you for pointing out the not so obvious.
The second someone spouts off "left" or "right" out of their mouths I know exactly who I am dealing with.
It is sad to see people still stuck in this false dichotomy.

I understand what you're saying but I don't think it is presumptuous, when another group steps forward in the same manner they will also become targets of such. The Tea Party never became a target in the same sense. The TPM became a target of Liberal Media disinformation with all the racism stuff and it probably would have progressed had the movement not been co-opted because before that point they had real power, a shot at really shaking things up.

Occupy doesn't fall into partisanship, it calls BS on the whole system...left, right and upside down. Occupy forces the system to show it's hand and expose the authoritarian state we are being swallowed up by. It may not even be the message of Occupy that they are afraid of...but they are afraid that large groups of people can't be intimidated into silence with pepper spray, tear gas and batons...they're afraid that their media can't contain it in a blackout because Occupy has made it's own media and that media has an audience....it may be small in comparison to CNN et al but the more people see how the two don't match up, the more people will start seeing how lied to we are and people don't like being lied to.

The system failed to co-opt and failed to silence Occupy, so now it has to become the enemy. I came across a great article the other day that I plan on doing a thread on that shows this.
