SAN FRANCISCO (CN) – A federal judge dismissed part of a class action accusing Wells Fargo of offering temporary loan modifications without the intention of ever making the modifications permanent. U.S. Magistrate Joseph Spero found the class failed to state a claim for breach of contract or debt collection violations while allowing unfair competition claims to remain. Spero also gave the class leave to amend the complaint to allege damages from the bank’s alleged contract breach.

Concluding that the public would likely be deceived by communications from Wells Fargo that claim the borrower would be offered a modification if the borrower complied with the terms of the TPP and forbearance the court found the allegations sufficient to hold up at this stage of the litigation.

Hmmm.. Surprising coming from the Fedeal districts on the Left coast. The the 9th circus court of appeals is one of the most overturned districts their is.

With that being said I am pleasently surprised with then judges ruling.

Maybe its coincidental but has anyone else noticed how the courts at all levels seem to be becoming more responsive to the people and doing the right thing instead of the political thing?

Even the US Supreme Court, new members and all, have made some rulings that shocked me solely because they didnt fit with some of the justiceis beliefs.

Maybe the world will end early after all lol..
