So this is the new spin then?

There is only one reason Holder is refusing to enforce the law and putting our security at risk, that is votes. So any spin out there is to get Obama reelected. The SCOTUS does not care about that. Illegal Aliens have no rights as US Citizens, nor should they.

This won't work. There simply is not enough illiterate, easily fooled people to fall for this.

Try again with a new spin later. Even the Hispanic community is opposed to open borders. They're not stupid.

Edited to take care of an oversight. Those who would do harm to the US like Terrorists want open borders and so do the Drug Dealers and Hard Drug Users.

Actually its not the flaw I found afterwards

Mine was if the where in any way officers of the court.

but this answered both flaws and my original insight....

first
United_States_Department_of_Homeland_Security

TextThe United States Department of Homeland Security (DHS) is a cabinet department of the United States federal government, created in response to the September 11 attacks, and with the primary responsibilities of protecting the United States of America and U.S. Territories (including Protectorates)[vague] from and responding to terrorist attacks, man-made accidents, and natural disasters. In fiscal year 2011 it was allocated a budget of $98.8 billion and spent, net, $66.4 billion.

At first and on face value you are wrong good sir...

The TSA would preform the same funtion it does not...

*snip* boy for the DoHS

picture in your head the way it works now if they find a gun or other weapon

The TSA has someone nearby to do the dirty part of arresting... they just act a s a scanning app...processing

same in this case...

They have legal right to finger your stuff now... under the Erie doctrine (and reverse erie) they would legally have the authority to perform this duty 'for the states

next they (DoHS )also have the authority of all the internal organizations that perform any of the functions I have mentioned...

Since the DoHS is the boss of the TSA, they(DoHS) are an inter agency organization

On March 1, 2003, DHS absorbed the Immigration and Naturalization Service and assumed its duties. In doing so, it divided the enforcement and services functions into two separate and new agencies: Immigration and Customs Enforcement and Citizenship and Immigration Services. The investigative divisions and intelligence gathering units of the INS and Customs Service were merged forming Homeland Security Investigations. Additionally, the border enforcement functions of the INS, including the U.S. Border Patrol, the U.S. Customs Service, and the Animal and Plant Health Inspection Service were consolidated into a new agency under DHS: U.S. Customs and Border Protection. The Federal Protective Service falls under the National Protection and Programs Directorate.

the sounds they made where of the fact it would take an indeterminate amount of time to determine who was a citizen

the major weakness is that right here- time in detainment... has to be outline through procedure and no answer was given

the probable cause is that you may not be a US citizen

the whole point of the major issue

while in custody the car and other items on you goes directly into police custody... the police have to account for it... allowing them to search it

as for reasons...

well you drive a rich looking car... you must not be from around here

well you drive a raggedy car you must be new here

it is all the cops would need in the states with similar laws

Ill be honest with you... might even destroy my creds on this...

I posted this thread with no intention of including the debate over immigration... the tools are being presented here to do very bad things legally... a backdoor....

the only thing immigration has to do with this is that it is possibly the false flag tool to get other things passed

or as one person so far has put it, thanks AZ.... thats the closest to the big I issues I was gonna go..

My opinion will only be stated if a mod ask... clearing me to add it... otherwise, this is about a huge legal potential reach the government can play this into....

I just love how folks bash the gov and want to restrict their involvement, but then when the gov is needed they are lambasted for not doing their job. Remember the idea of gutting the gov and laying off all those employees that get paid too much? So which is it? Gov good or gov bad? The answer is both, which is why it irks me to see an all out attack on one party or entity as if the world would be better off without their existence, when there is plenty of blame to go around for everyone, gov, corps, parties and citizens. Balance is all I wish for....

odd your comments are just odd

???? I will bypass computerized suspicions

I am curious... how is this thread about coming down on AZ...

I never blame a tool for the job a user uses it for....

I think so far people have severely underestimated Obama...

I am not going to devolve this thread...

I know at least part of this SHOULD be struck down...

the detainment part, is a violation of civil right clear cut

might not be police powers already allow them to take you into protective custody or detain you for 48 hours, they may get hit with this limit imposed

I am from Arizona and I am a libertarian and I support most of this law as written... The part I have a problem with is not a topic of most peoples conversation but I must explain a few things to you.

The law the supreme court is investigating is SB1070, my state's attempt to control illegal immigration. You may not understand what things are like in Arizona but the drug cartels behead people in our cities - they enslave hundreds and leave them in squalor without necessities and they tend to disregard many vehicular laws such as driving with insurance or driving without being under the influence. The illegals tend to crash and kill people more than any other demographic.

They disregard all of our laws such that the rule of law is bending and soon will break.

SB 1070 does not allow any law enforcement official to stop anyone they desire and perform a citizenship check... in fact, the law enforcement do not even EVER perform a citizenship check.... ICE performs the check. I have no problem with requesting ICE to verify citizenship of those people who HAVE ALREADY BROKEN an Arizona State law and are being arrested... Right now about 40% of our inmates in Pinal county are illegal and that costs $$$.

You need to understand that the media and even the president have lied about SB1070... That's right, president Obama lies and mislead the American public by saying SB1070 allows police to stop people on their way to a pizza... That was a lie and people believed it without verifying it.

Obama is trying to court the illegal and hispanic votes by feigning empathy but if you judge Obama by his actions than you will know his DOJ has assisted in the killings of hundreds of INNOCENT Mexicans along with 2 of our border patrol agents. This ruling will not give the TSA any arrest authority - they have none nor can they even detain you... they always need to call local law enforcement.

SB1070 is what American needs - don't support the slave trade or the drug trade - it only pays for more big government!!!

People like myself expect to do the things the federal government is required to do under the Constitution - like protect our borders...

People like myself do not want the federal government spending our money on a study of how Chinese prostitutes with sex diseases spread their disease in China...

There are differences that are very easy to understand if you look into things

But what if government officials from America are spending quality time in China committing unpublicized acts with risky partners?

This information is important, especially if Clinton was into orientals...

I do not know if anyone has made mention of this yet but the Supreme Court is not expected to come to their decision until June.

And, of course, we get no say in this. Gotta love this country we live in, less and less freedom everyday...

Actually, you're wrong on this: you never had any freedom to begin with, at least since the Fed came into being. What are actually loosing is the right to due process, and a due process you can afford and that is clear, concise, and affords you the opportunity to challenge the system at any point. That's what you are are loosing, your freedom was a trick your mind played on you as you had none and still don't.

Worse, the Constitution that so many use as their antidote to these increased restrictions is actually the worst document they could be using, as that document took "rights" you have by simply existing, and codified them, thereby making them a discretionary privilege that is subject to the very revocation happening now via the process of "law." While some were taught the document helped create freedom, it did nothing of the kind, it simply made it a commodity owned by the "government" or "elite" to control folks with. Freedom is NOT something granted by a government or a king, it is the core of who you are and cannot be separated from you unless you allow it to be traded.

The two thoughts that come to mind, should this pass, are: "It will help catch the hundreds of millions of terrorists who hate our freedoms," and, "if you've got nothing to hide..." Man do I love mind control memes.

again this thread is not about immigration

the crime rate does not demand more police.... smart police work and intelligent rulers are demanded

I am originally from florida and live in texas

The only part of socialism as your describing that is a part of this thread is the use of power and the classic fallacy of those operating on its principals...

none of what you mentioned is necessary or even required to get things done

I have to hear this, how am I choosing the bad one...

I for one hope I am wrong... I just saw a line of thought and measured it against reality.... the laws are there that when used make this all legal....

Again I think I have to point this out on if I am a liberal or a conservative

-does the politician deliver on what was promised... is the merchandise reliable or crapola

-is the track record one of good government (notice honesty was not included)

-are my interest protected

-does the politician stay bought or do they go to the highest bidder with flip flops

High standards I know
I do not expect honesty- for I have learned an ancient pagan magic to tell if a politician is lying to me
look to see if there mouth is open, if it is they are lying

now backing off for a second and looking at your claims with different glasses

NO

the basis of the argument is that we want this

the next part is that is is due to outside locus

the main part you miss is even is we took what you said at face value your main idea is set awash with a simple rule..

keep corruption and theft out of the lower levels of government (keeping it at 2%) the resources are there... again however trying to maintain the thread tie in

the amount of corruption present Id say nope ... with a lower level of corruption and a much higher level of trust then I would be wrong... the corruption is to high at local levels and the big boys are from local levels

As it sits I would not trust any government employee to feed my cat let alone write laws that affect my viability....

just popping in here to say... the liberal vs. conservative argument is so old and tired and blatantly false that i can't believe users here still persist with it. don't forget, the patriot act was passed by BUSH, a republican. it doesn't matter, democrat or republican president, the attack on our constitutional rights will continue regardless of administration leaning.

all the agencies you mention are Department of homeland security

DoHS!!!!!!!

TSA processes and its cheaper to have them sit there and act like security guards then the training investment for police...

the authority is derivative

they can use the law in this case for the reach...

the feds can use the outcome to run agents there...
