I don't think this is allowable. I don't think Holder will respond.

The judges are within the Judicial Branch of Government.
The Attorney General is within the Executive Branch of Government and is by the way "appointed."
Unless I am mistaken (possible after all) I don't believe Eric Holder is the Attorney of Record in the case before the 5th Appellate Court. The Court can demand a response from the attorney for the Government inside the courtroom but I don't believe they have the jurisdiction to order an attorney who is not of record, respond to a demand. Congress can but I don't believe the Court can.

What these judges are demanding is that Holder take a knee before the Court and declare submission to a higher authority. Holder has too much arrogance to do that and will fight it. This is going to lead to a confllict between the Executive Branch and the Judicial Branch that could escalate as never seen before.

I would love to see Holder eat crow but I don't think he has the courage to do so.
Either way we win. Holder/Obama have to cede authority of the Courts or fight to preserve the Presidential monarchy. Either way, it is going to be fun.

He may not have to, but if he doesn't, well, sometimes people don't like being ignored. If he ignores this he could be seen as being insulting and lose the support of the supreme court.

It was a bad move for Obama to express such an opinion that could be taken as a threat. He truly does need to clarify himself on what he means and if he means to retaliate should the SC strike down Obama care.

In other words, Obama put his foot in his mouth, and now needs to be held accountable for his actions.

He shouldn't have said a thing in the first place.

Obama doesn't have to respond at all.

The order went to the DOJ, not Obama.

The DOJ will respond telling these judges that they are morons and of course the SCOTUS can overturn laws, I don't think they should respond at all...I don't think they legally have to.

I find it hilarious that people think Obama issued a "threat" but no one can articulate what the "threat" actually was.

Crazy thought, but the idea of it made me laugh.

Mr. Prez lying in bed thinking how to handle his worst case scenario - Obamacare voided by SCOTUS. Wondering if he can pull off another Executive Order nullifying the Supreme Court decision.

At this point in his career nothing would surprise me.

well it really wasnt a threat the way I see. It was a shot across the bow though. Saying it was unprecedented to over turn a law based on constitutional grounds is unprecedented? really? what about the the heller care? The scotus does this every day how exactly is it unprecedented? Then he insinuates they do not have the authority by calling them unelected people. No, they are not elected, but appointed, he should know, he appointed two of them, which brings me to the whole judicial activism comment...really Barry? You are gonna talk about that after appointing the pair of judges you appointed? Really? Kagen and Sotomayor and you have the gall to say anything about judicial activism? wow, the audacity of this man is really something else. Geuss you really can not expect much more from the Man-Boy in chief.

Obama still doesn't have to respond...Obama can go out tomorrow and say exactly what he said yesterday and repeat it every day until June...and no one can do a damn thing about it because nothing he is saying is illegal.

And if the DOJ does respond...it will be with citing precedented case law and will be very non-specific in regards to Obama's comments.

This is all just show from a repbulican panel of judges....and people are falling for it.

Go read Obama's comments.

The "unelected" part came from him para phrasing what Conservatives have been saying for years.

But Fox News and other Right Wing outlets are good at spinning...and people are good at letting others think for them.

I'll take that as an admission that you can't find a "threat" in Obama's comments.

It's really a simple question if there is any truth to the claim that there was a "threat".

But there isn't any truth in it....because it is a lie that people have fallen for.

I am not a Progressive, Socialist, Liberal, or Marxist.
You may have a hard time recognizing a Constitutionalist, Capitalist, Conservative.
