That so-called treaty is an antiquated cold war proclamation already breached by private industry launching communication satellites, and countries never dreamt of in 1967 with satellites. If Bill Smith launched a mining probe to the moon and brought it back to earth I doubt he would face any reprimand. If John Doe went to live on the moon I doubt NASA would rush up their to trow him in jail.

No private company will. But countries do often spend in such way. Governments are not at all restricted to spend only on financially profitable activities.
