I have been quite vocal on my disapproval of the so called "OWS" movement in general. I have conversely also been quite vocal that these people
have a right to peaceably assemble.
Some in this thread present a scenario of only peaceful protestors. Others present a scenario of only thugs and "anarchists" who have cost the city
"tens of thousands of dollars". I suspect that both, on some level, is true.
Regardless of who the thugs were, and who the innocent protestors were, you are my friend and my brother. I trust you when you assert that you were
innocent of any crime and doing what you did by right. Because of this, here now is your opportunity to bring some actual meaning to this meaningless
leaderless movement.
If you were arrested for exercising a right then the arresting officers acted criminally. If you have been charged with a crime, it is imperative you
do not plead and challenge the jurisdiction. That jurisdiction must be proven to exist on record before any trial can move forward. Assuming you
were merely exercising a right, then it is easily predicted that no jurisdiction can be shown.
If upon challenge of jurisdiction, the prosecution drops the case, then that prosecutor has not acted criminally. If that prosecutor ignores your
challenge of jurisdiction, then that prosecutor has acted criminally. If the judge dismisses the case, then that judge has not acted criminally. If
the judge ignores that challenge of jurisdiction and imposes a plea of not guilty on you, then it is up to you to obtain a not guilty verdict under a
defense of challenging jurisdiction. This is how you allow the criminals to bind themselves to their own criminality.
Assuming the prosecutor dismisses upon challenge of jurisdiction, then the judge is moot, the prosecutor has plausible denial-ability. The arresting
officer(s) do not have this plausible denial-ability and have all ready acted criminally. If you do not use this incident to file a verified
complaint against all those who acted criminally then this is just another tragic example of the uselessness of this protest movement.
Stand tall and demand justice. Don't just protest for it, demand and get it!
