As we can see the SCOTUS at the time set the precedent by allwing the resistance of the subpoena by allowing the the POTUS to use his own conscience to make the decision.

Written at a time when it was assumed the POTUS would actually have a conscience!

if he wants on the ballot he will likely, send to the court for an extension.

Or he will be stricken from the vote and have thrown his first state to the dems. No big deal.

Its only going to be more black panthers and election fruad through the next hatch of acorns.

Can the court privately hire someone to rein him in and haul his ass to court?

Will he really be removed from the ballot in that state?

I think if he doesn't show up, there should be a warrant for his arrest.

Well, that's how it works for us serfs in Australia.

Unfortunately I think that only applies to us mere mortals

That's what I'm assuming his actions are inferring.

Who needs the law anyway when you have a country to finish destroying?

Heh. I'd laugh if it wasn't so true.

[sigh]

What ballot? He's the only democrat running, there is no democratic primary. It's a publicity stunt, and nothing will come of this, just as nothing has come from the numerous other laughable court cases. You can all name call, and hurl insults, but you know it as well as I - this means nothing, and won't affect anything. If I'm wrong, then I'll admit that this president was nothing but Kenyan born, communist, anti-Christ demon from hell
But even if that prior statement was true, NOTHING WOULD COME OF THIS. You can hope, pray, and wish, but we should all know by now that this is nothing but distraction. But, if I could wager on this, I'd bet this Case goes the same way all those birther cases went - nowhere.

The train left not too long ago for most of you calling for him to obey an order from a puny state judge.

He's the PRESIDENT, not a police chief, not a mayor and certainly not a senator!

This is exactly what this is about... about a man who feels he is quite far above anyone else.. All other authorities are "puny" to him.. Imagine how puny you are to him? You think because you love everything about him that he would let you join his club of authoritarians? He would spit on your grave, and figuratively speaking, he already has done that by way of the new laws and executive orders he has penned to gain more power over your life..

Hitler also had admirers that he had put to death later because he couldn't understand why they liked him so much and he thought they were just trying to fool him so they could spy on him..

I do admire your devotion to obama and that he can never do any wrong in your eyes, even if it is quite missplaced admiration..

This is exactly why he was elected, he was able to appeal to all you ultra idealists and has used it to the maximum effect.. Do you think he would care about, or even respect any of you folks for being so easily duped?

This is proven everytime he makes a promise and then does the exact opposite of what he said he would do for his followers.. IS that showing that he cares one smidgeon for you?

Here's why this is a non-issue: McCulloch vs. Maryland. Maryland attempted to tax federal banks, but the Supreme Court decided that Maryland, a state government, does not have the power to impede the actions of the federal government in such a way. Reason.com explains it: "The national government could not be held hostage to the intense policy preferences of a political minority that happened to control a state government. Similarly, the president cannot be held hostage to the whims of a local prosecutor or trial judge, even if the motives of the state court are sound. The constitutional consequences of placing the president within the power of a state court are too severe to depend merely on good faith." -Reason.com - Serving the President (this was written around the time of Clinton's subpoena)

Info on McCulloch vs. Maryland

So, what it comes down to is, Obama is not constitutionally required to appear before a state court. This is a Georgia State Judge, if I am correct. He WOULD be required to appear before a Federal Judiciary, however, according to the first article I cited. But since this is a judge of the state of Georgia, there is already legal precedent that says the President is not required to appear before a state judge.

If Obama has to appear in court, then he should do it, even if it is something as stupid as this birther nonsense, and even if the people who get proven wrong still cling to this idiotic conspiracy theory.

He probably will whenever the extension is for. Its merely a change in the election route for 1 day.

He can always say the records dont exist anymore. Lost em all in a horrific boating accident.

Good job on making a stronger case for the plaintiff Obama.

Nothing to hide? Sure seems like hes trying to hide ALOT.

maybe those birthers arent wrong.

Actions like this doesnt help him at all.

What? Obama is not going to do something he doesn't want to? You mean he isn't going to obey the law?

NO WAY!!??!

Do you feel the same way about Bush as well? I did and I was one of those who were hoping that he and Cheney would be dragged to the Hague to face charges. Never happened. Canada threatened it. Never happened.

Once we all accept that TPTB is not going to let anything bad happen to their puppets, we can see the bigger picture for what it is.

This story is nothing but symbolic because the outcome will not be much different.

You can view the man's birth certificate.

What more do you people want?

Why not attack Obama based on his performance in office? Why get hung up on this #?

I think that birthers are sheeple too at least when compared to others.

Thier was a time when the law didnt appy to most black men.

Racism is a helluva drug.

Thanks for bringing facts to the table.

I just love the amateur Constitutionalists and legal experts here on ATS, who think they know so much, but are actually embracing ignorance and speaking from a complete void of knowledge of the law.

Oh, well, at least it's entertaining!
