It is called a recess appointment. It happens all the time. Obama has used it much less than previous presidents.
Someone should have been appointed to that agency a long time ago but republican obstructionism has prevented it for years. We can't have any regulation over the predatory capitalist now can we?

As far as Libya is concerned, you may want to reread the War Powers Act. I know the right loved to use Libya to make it seem like Obama did something unconstitutional and he should be impeached but the truth is very different.

Maybe some sneeky corporation somewhere is demanding some "decisions" be made in their favor ?

The "Consumer Financial Protection Bureau" might have some backhoe ditches to fill in.

After all, we the people, the majority of American citizens needs some more fees to pay somebody somewhere right ?

The Repubs must have a feeling or two.....

Last year, 44 Senate Republicans said they would not confirm any nominee as director, regardless of party, until structural changes were made to the bureau’s accountability. “But once again, the President has chosen to circumvent the confirmation process,” McConnell said.

“The CFPB is poised to be one of the least accountable and most powerful agencies in Washington,” McConnell said. “Created by the deeply flawed Dodd-Frank law, it is subject to none of the checks that independent agencies normally operate under, and will have an unprecedented reach and control over individual consumer decisions.”

Cordray should be willing to testify before Congress for a Jan. 24 hearing, said Rep. Patrick McHenry (R-N.C.), the chairman of the House Oversight and Government Reform subcommittee on TARP, Financial Services and Bailouts of Public and Private Services.

Congress is NOT in recess.
President Obama will appoint Richard Cordray to be head of a controversial consumer consumer financial protection agency despite the fact that Congress is not officially in recess.

White House Communications Director Dan Pfeiffer tweeted the widely expected announcement on Wednesday before the president headed out on a campaign-style event to Ohio.

"We Can't Wait: Today in Ohio, President Obama will announce the recess appointment of Consumer Watchdog Richard Cordray," he tweeted. Cordray was to appear with Obama during the official announcement in Cordray's home state.

The Constitution does not expressly forbid such an appointment, which would technically come as an intrasession posting. But the defiant move is sure to raise questions of executive power and whether the administration is overstepping its authority.


What about the president power?
US constitution
The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.

The senate ain't in recess, so Obama is CLEARLY abusing executive power.

They block every appointment he puts up....Republicans are siding with the banks that we just bailed out.

Which Obama voted for. And let's mention that Obama's biggest contributors are the banks.

This whole consumer protecting business SOUNDS good, but I bet it ends up screwing good small businesses doing competition to the big wigs giving money to both parties.

In case you hadn't noticed, it's not just presidential appointments that the republicans have been blocking, they've been blocking everything Obama and the democrats support. Even if it means they have to reverse a previous republican held position. They block everything just for the sake of opposing Obama at every turn in an attempt to insure that his policies fail helping them to accomplish their #1 stated goal, which is to make Obama a 1 term president.

How you ask? They do it via their newfound strategy of eliminating the "simple majority" in the senate and filibustering everything they disagree with, insuring that it now takes a "super-majority" of 60 votes to get anything passed. If I'm not mistaken, in a best case scenario, the democrats can only muster 53 votes, so you can see how it's really quite easy for them to block virtually every democratic initiative brought before the senate.

Judging by some of your post in this thread, it's apparent that you're pretty much in the dark about this entire agency, how and why it was formed and more specifically, how the republican establishment has done everything in their power to see that it never gets up & running. I would suggest reading this article from Wiki as a good place to start;

By the way, I agree wholeheartedly with what the President has done. If Congress doesn't want the POTUS, (regardless of political affiliation) to make presidential appointments then they should stay in session and do their damn job! You ever heard the old saying; "Lead, follow, or get the hell out of the way?" Well I'm actually quite pleased that Obama finally decided to stand up to the blatant republican obstructionism and "Just Do It." At least now Congress will have to do something instead of just sitting on their asses and doing nothing.
