i have seen where a county built a new road and the road cause a spring to backup water on a persons land and the democrat treehuggers then called the area where the water backed up a wetland and took away the property owners right to use the land (and water) without even paying for the land. at lest the pipeland people will pay for the land under eminent domain.
there are many cases where the democrats have taken land or the right to use the land without paying a cent for the property.


All true. It happened in Appalachia too years ago. My family (and others) lost a lot of land to eminent domain because of Ford Motor Company. Ford didn't even use the land and gave it to the government, who turned it into a National Park.

If the court and jury permit it, Thompson and the others will be paid "fair market value" for the use of the right-of-way, and any impairment of access or loss of value to the remainder.

Good Question...Since you seem to be claiming specific legal knowledge in this area, perhaps you can explain how a Foriegn National Corporation can claim Emminent Domain and Seize the Private Lands of American Citizens for the purposes of a For-Profit pipeline...before even recieving a permit to build it?

As far as a "jury of peers" making that determination...amen to that! I will be perfectly satisfied with AMERICAN Citizens making the determination on the now 100 plus landowners facing these threats from Canadian Keystone XL.

Democrats have done it in the past ...so it's OK for the GOP to do it? THAT is your argument? That doesn't seem weak logic to you? Democrats have have been found guilty of corruption before...thus corruption is OK? Is that how this thinking works?

Or is it the "GOP" part of my thread that bothers you? Because the GOP are the ones that have screamed and made this a National issue every chance they get...the GOP are the ones backing the pipeline...which is what this OP is about.

It is of particular irony that the GOP has made property rights a cornerstone of thier political platform, but are willing to sell that pricniple to a foriegn corporation for the right price.


The opposition to a Foriegn Company seizing private Americans land for profit is a BI-PARTISAN issue at the citizen level, and only the most entrenched idealogues would race to back thier establishment party rhetoric without listening to the people

TransCanada has threatened to use disputed eminent domain powers to condemn privately held land, over the owners’ objections. And that’s creating unusual allies — Occupiers, Tea Partiers, environmentalists, individualists — united to stop TransCanada from threatening water supplies, ancient artifacts, and people’s basic property rights.




They continually called me, like once a month or whenever they felt like it. Kept the pressure on us. Made us an offer, $9000. Whatever the offer was, we just don’t want the damn thing on our property.”

That’s when TransCanada really stepped up the pressure.

“In July 2010, we got a written letter from TransCanada, they told us if you don’t accept this within 30 days, we’re going to immediately start eminent domain proceedings against you,” Thompson said. “They didn’t say anything about a permit. I tried to contact the Governor’s office. All I got back was a form letter talking about the pipeline.”

The letter goes on, “While we hope to acquire this property through negotiation, if we are unable to do so we will be forced to invoke the power of eminent domain and will initiate condemnation proceedings against this property promptly after the expiration of this one month period.”





The result: protests in Paris, Texas against the pipeline, on Crawford’s behalf.

“You could check off 20 different kinds of boxes, politically, professionally, temperamentally,” Crawford said. “We had Occupiers, Tea Partiers. This is about rights as a landowner.”

"Eminent domain" is used all over the place. We see it in cities too, and some cities will use it in the event of an "eyesore" that has nothing to do with infrastructure needs. Ok, so what do you do if someone holds out and says no you can't build you pipeline here, or no that road can't go here, or that subway can't pass my 100' by 100' piece of property? Do you make huge squares around all these lands? Do you pay a king's ransom as they holdout?

There is a real purpose for "eminent domain"

(1) Only if you fight and appeal the case the whole way....you MIGHT be given a jury of your peers.

(2) In the meanwhile, you pay the attorney fees. They do work on contingency, but ONLY if you settle for a price and they they take a cut. If you simply want to keep your land, the attorney fees and court costs are all yours.

That happens all over and it is usually unmaintained property. Vacant building where the owner stops any upkeep usually results in squatters, drug-dealers etc. They can be a danger to cities. Those abandoned buildings are where the cops regularly find dead bodies.

3 questions and no "kings ransom".

(1) Government?...or Foriegn corporation for-profit?
(2) A highway? OK demonstrate critical interest to the state or government. To the citizenry. The last time I saw a road built in my town that utilized eminent domain, they made a convincing case that the road cut 15 minutes off of ambulance response times and transport to the hospital for half the county.
(3) If it was the US Gov. vs a Foriegn For-Profit corp...and it was a highway that could be shown to be of critical importance to the safety or security of the people...then the Gov. names a price within reason and that is that. For a price you can fight it, but you can also lose money depending on outcome.

The jobs created claim has been shown to be bunk and even Keystone has backed off of thier claims for job creation. Even if jobs created was a sufficient cause...THAT is an insane justification for taking peoples lands away. That is what has happened to south American countries in the past century...Bananna Republic...Sugar Cain? Big foriegn companies want your resources and the government takes your land away and gives it to them for the sake of the economy. BAD...BAD model.

....... if we are going to start letting foriegn for-profit companies seize private citizens land for the sake of Foriegn Companies oil transport...why not solar farms? Natural Gas? Minerals critical to new tech battery production? What's next? Food supplies? Midwest farms? Food is right up there with energy...It goes on and on.

A highway needed by the government is a whole different animal than an Oil Pipeline owned by a foriegn corporation to make money.

And once we start considering those things the same...we become a crappy little country to be exploited by international corporations with the our own government as plutocratic enforcers.

The US GOV...Both Democrats AND Republicans do it to protect wetlands...and not to save birds, but to make sure your don't drink pesticides and feces. Wetlands clean your drinking water.

AND both Democrats and Republican citizens vs. GOP in DC are against taking American lands and giving them to a Foriegn corpoartion for profit.

Unless this looks like a liberal democrat rally to you?....

What i don't understand is why everyone thinks because blocking the Keystone is going to stop oil spills.

They can still bring the oil down without the pipe line by using oil trains.

These oil trains would be a lot more dangerous then the pipe line and there would likely be 3 to 5 a day ay the minimum.

Just look at the rate of train derailments in the US every week

Its way more likely to have a oil spill from a train wreak then from a pipeline leak.
