The news is that a federal judge this week has ruled against the students.

Following the incident, a lawsuit against the district was launched by the students and their families. This week, the case came to a close, with a federal judge ruling against the students — a blow that is likely to infuriate some free speech advocates.

I see, my apologies. I didn't realize that the verdict just came in.

Thank you - no apology necessary. The OP was somewhat unclear, and I was actually reading about the matter when this thread popped up.

This is an important decision and deserves a decent debate.

Cinco de Mayo commemorates the Battle of Puebla and is celebrated regionally, it is not at all an official holiday in Mexico and has little recognition outside of the state of Puebla. It is much more popular in the United States where it is widely recognized and celebrated nationally. It is observed in the US as a celebration of Mexican heritage and pride. Cinco de Mayo for the most part is an American holiday.

Cinco de Mayo (Spanish for "fifth of May") is a holiday held on May 5. It is celebrated nationwide in the United States and regionally in Mexico, primarily in the state of Puebla.

United Press International reports that "The holiday crossed over into the United States in the 1950s and 1960s but didn't gain popularity until the 1980s when marketers, especially beer companies, capitalized on the celebratory nature of the day and began to promote it."

The questions are whether the students wore their flags to incite discord and perhaps more importantly if such an act should be perceived as provocative.

Take the celebration in the spirit intended, have a beer and a taco and enjoy the party.
