Where in the story (except a misleading title)does it say anything about the issue reaching the Supreme Court? It says something was released pursuant to a local Superior Court ruling. A Superior Court is a bottom tier court in California.

If you're referring to the birth certificates that he's provided: well, that's the whole point, isn't it--whether those are true copies or counterfeits? I'm tired of this entire thing too, but I would like to know the truth. But it won't be found by declaring your personal belief as a fact....

Actually, it states that Leo Donofrio's case would be allowed by Scalia

In a related matter, under growing pressure from several groups, Justice Antonin Scalia announced that the Supreme Court agreed on Tuesday to hear arguments concerning Obama’s legal eligibility to serve as President in a case brought by Leo Donofrio of New Jersey .
