Third appeals court upholds health-care law

Conservative judge Laurance Silberman stated:

It certainly is an encroachment on individual liberty, but it is no more so than a command that restaurants or hotels are obliged to serve all customers regardless of race, that gravely ill individuals cannot use a substance their doctors described as the only effective palliative for excruciating pain, or that a farmer cannot grow enough wheat to support his own family. The right to be free from federal regulation is not absolute, and yields to the imperative that Congress be free to forge national solutions to national problems, no matter how local–or seemingly passive–their individual origins.

In a world where the 10th amendment hadn't been written, this Judge would be 100% correct. Unfortunately for him, the 10th was written along with the other original 9 and he was put on the Bench to interpret the law BASED ON THOSE not his idea of how it 'should' be in a world we aren't actually living in.

Whatever.... Stench from the Bench has become par for the course. This Obamacare boondoggle won't be settled outside of the Supreme Court and anything short of it is just time wasted in getting to that final showdown for all the marbles. Lets drop this side crap and just get right to the Super Court to finish this.
