This would be known as Burden Of Proof which someone in holding should not do their job for them, it is up to them to prove their case.

The feds lost the password case, meaning the defendant could hold on to the password, as it was in his mind. They appealed the decision

They are saying that since they already saw what was on the disk when it was unencrypted that they already know whats on it and he needs to reveal the password. That case was in 2008 (the boucher case)
